WHEREAS, as part of the Rice Avenue project the City is required to mitigate the wetland that existed on Preservation Way and had planned to mitigate the site by creating additional wetlands at Gahanna Woods; and
WHEREAS, it was found that the Gahanna Woods mitigation was cost prohibitive and it was decided to change the mitigation option to purchase wetland credits to satisfy our obligation; and
WHEREAS, the City can purchase 0.6 acres of wetland mitigation credits in the amount of $22,800 through the Rice Avenue Bond Funds; and
WHEREAS, it is necessary to enter into an agreement with the Ohio Wetlands Foundation to accomplish this and the Director of Parks & Recreation a has recommended we proceed; and
WHEREAS, it is necessary for the City to satisfy the obligation as soon as possible with the Ohio Wetlands Foundation, and all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into Wetland Mitigation Purchase Agreement Big Darby Hellbranch Wetlands Mitigation Bank with the Ohio Wetlands Foundation, 1220 Stone Run Court, Lancaster, Ohio 43130; Agreement attached as EXHIBIT A, and made a part hereof.
Section 2. That funding in the amount of TWENTY TWO THOUSAND EIGHT HUNDRED DOLLARS ($22,800) was set aside in the 2010 Appropriations to Account No. 631.350.5596, Stormwater, Capital Projects/Improvements, to cover the herein costs.
Section 3. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
