WHEREAS, application has been made by Glen Dugger on behalf of the Stonehenge Company to zone 6.49+/- acres of land, more or less, recently annexed to the City of Gahanna from Jefferson Township;
for property located at 5050 and 5101 Shagbark Road; and
WHEREAS, Planning Commission held Public Hearing on November 3, 1999, and denied the request for this initial zoning; and
WHEREAS, applicant appealed the denial by Planning Commission in a timely manner and Council held Public Hearing on December 20, 1999, in regular meeting, said meeting held pursuant to notice and according to law;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Official Zoning Map, adopted by Ordinance No. 198-96, passed November 19, 1996, and as amended to date, is hereby amended by rezoning 6.49+/- acres or less, to L-AR, Limited Overlay Apartment Residential, said acreage more particularly described in EXHIBIT A, attached to this ordinance and made a part herein.
Section 2. That the text and site plan as required by Section 1152.01 (1) (2), Procedures of Chapter 1152, Overlay Districts, is attached to this ordinance as EXHIBIT B, and is made a part herein.
Section 3. That the public areas dedication required under Section 1109.08 shall be in the form of a combination of park land and fees in lieu of and shall follow the procedure outlined in Section 1109.08 (h) (i) and (j) of the Codified Ordinances.
Section 4. That the Clerk of Council is hereby authorized and directed to amend and recertify the Official Zoning Map of the City of Gahanna, Ohio, to reflect the zoning contained in and approved by this ordinance.
Section 5. That this ordinance shall be in full force and effect after passage by this Council and on the thirtieth day after the date of signature approval of the Mayor.
