TITLE
AN ORDINANCE AUTHORIZING THE MAYOR TO ACCEPT AND ENTER INTO AN ACCESS AGREEMENT WITH OHIO POWER COMPANY, SUCCESSOR-IN-INTEREST TO COLUMBUS AND SOUTHERN OHIO ELECTRIC COMPANY, FOR PUBLIC SAFETY VEHICULAR ACCESS TO 825 TECH CENTER DRIVE; AND DECLARING AN EMERGENCY
BODY
WHEREAS, the property located at 825 Tech Center Drive was identified as an ideal property and building to address the operational needs for Police Headquarters, City Hall, and the Senior Center; and
WHEREAS, construction of this municipal civic center began in May 2024 and is making steady progress; and
WHEREAS, to avoid an additional point of egress onto Tech Center Drive, the City desires to purchase an access easement from Ohio Power Company to allow public safety vehicles only to access the secure parking area for Police Headquarters from the Ohio Power Company property; and
WHEREAS, the proposed cost of the access easement is $13,000, which runs in perpetuity with the land and grants future considerations for maintenance of the easement area; and
WHEREAS, the Administration requests passage of the ordinance as an emergency measure immediately necessary for the preservation of the public peace, property, health, safety, and welfare; to wit: alignment with the construction schedules for 825 Tech Center Drive.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to accept and enter into an access easement agreement with Ohio Power Company, successor-in-interest to Columbus and Southern Ohio Electric Company, whose primary offices are located at 1 Riverside Plaza, 16th Floor, Columbus, Ohio 43215; said access easement agreement attached hereto as EXHIBIT A and made a part herein.
Section 2. That for the reasons set forth in the preamble above, this Ordinance is declared an emergency measure which shall be in full force and effect immediately upon passage by this Council and on date of signature of approval by the Mayor.
