TO AUTHORIZE THE MAYOR TO ENTER INTO AGREEMENT WITH THE OHIO DEPARTMENT OF TRANSPORTATION FOR FRA-BRIDGE REPAIR FY13; FOR I-270 BRIDGE OVER BIG WALNUT CREEK LOCATED JUST NORTH OF THE HAMILTON ROAD INTERCHANGE.

WHEREAS, the State has identified the need for repair of the bridge over Big Walnut Creek just north of the Hamilton Road interchange; and
WHEREAS, ODOT has responsibility for maintenance of this bridge but because it is located in the Gahanna Corporate boundary legislation of consent is necessary so they can proceed with the work; and
WHEREAS, the City (LPA) hereby gives consent to the Director of Transportation to complete the above described project;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. The LPA shall cooperate with the Director of Transportation in the above described project as follows:
The City hereby grants consent to ODOT for its development and construction of the project in accordance with plans, specifications and estimates as approved by the Director.
Section 2. That ODOT agrees that all right of way required for the described project will be acquired and/or made available in accordance with current State and Federal regulations. ODOT also understands that right of way costs include eligible utility costs.
Section 3. Upon completion of the described project, and unless otherwise agreed, ODOT shall: (1) provide adequate maintenance for the described project in accordance with all applicable state and federal law, including, but not limited to 23 USC 116; (2) provide ample financial provisions, as necessary, for the maintenance of the described project; (3) maintain the right of way, keeping it free of obstruction; and (4) hold said right of way inviolate for public highway purposes.
Section 4. That the Mayor is hereby authorized on behalf of the City of Gahanna to enter into contract with the Ohio Department of Transportation.
Section 5. That this ordinance shall be full force and effect after passage by this Council and 30 days after date of signature approval by the Mayor.
