WHEREAS, application has been made by Contemporary Construction Services, Inc. by their agent Donald T. Plank, to zone 274+/- acres, more or less, said property located at 4479 East Johnstown Road; and

 

WHEREAS, Planning Commission held public hearing, said hearing held pursuant to notice and according to law and, as a result of such hearing deliberations, on August 14, 2002 Planning Commission recommended this initial zoning; and

 

WHEREAS, this zoning will meet their park land dedication requirement by the giving of land; and

 

WHEREAS, Council held public Hearing on October 7, 2002, pursuant to notice and according to law;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Official Zoning Map, adopted by Ordinance No. 198-96 on November 19, 1996, as amended, is hereby amended by zoning 2.7+/- acres, more or less, to AR, Apartment Residential, said acreage more particularly described in EXHIBIT A attached hereto.

 

Section 2.  That the public areas dedication required under Section 1109.08 shall be in the form of park land dedication of at least 0.41 acres and shall follow the procedure outlined in Section 1109.08 (h)(i) & (j) of the Codified Ordinances.

 

Section 3.  This land dedication shall be combined with the 2.25 acres required by the passage of ORD-0229-2001 to make a total dedication of 2.66 acres for rezonings to AR by Contemporary Construction Services.

 

Section 4.  That the Clerk of Council is hereby directed to amend and recertify the Official Zoning Map of the City of Gahanna, Ohio, to reflect the zoning contained in and approved by this ordinance.

 

Section 5.  That this ordinance shall be in full force and effect after passage by this Council and 30 days after signature approval by the Mayor.
