CUPPY AND JUDITH N. JAMES-CUPPY; TO WAIVE SECOND READING; AND TO DECLARE AN EMERGENCY.

WHEREAS, a Petition for the annexation of 0.887+/- acres from Jefferson Township to the City of Gahanna has been filed by Joe Gatto II, agent for petitioners James A. Cuppy and Judith N. James-Cuppy; and

 

WHEREAS, a hearing on said Petition will be scheduled before the Board of County Commissioners of  Franklin County; and

 

WHEREAS, Section 709.31 of the Ohio Revised Code requires that before said hearing the Municipal Legislative Authority shall adopt a statement indicating what services, if any, the municipal corporation will provide to the territory proposed for annexation upon annexation; and

 

WHEREAS, said services ordinance must be passed within 20 days of the filing of the petition for annexation and it is, therefore, necessary to effect this legislation immediately for the orderly progression of the annexation procedure, and for the preservation of the public peace, health, safety and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the City of Gahanna hereby consents to this annexation.

 

Section 2.  That the City of Gahanna will provide the following municipal services for the 0.887+/- acres in Jefferson Township upon the acceptance of the annexation of the said area to the City of Gahanna:

 

POLICE:

 

1.  The tract is located on a main thoroughfare.

 

2.  The City of Gahanna provides 24-hour police protection, criminal investigation and traffic control through the efforts of various segments of the Division of Police.  The Department is comprised of 53 sworn full-time officers, 5 sworn part-time officers, 22 sworn Reserve officers, and 10 civilians.

 

3.  Optimally the Department operates 8 cruisers on patrol throughout the City per shift; a shift never has less than 5 cruisers on patrol.

 

4.  The entire area is routinely patrolled by the officer assigned to the area in question; anticipated response time to a police emergency is 3 to 5 minutes; non-emergency response is generally 5 to 10 minutes.

 

5.  The City of Gahanna is part of the 9-1-1 Emergency System that allows quick response to emergency situations; the department anticipates no problems in providing police protection to this area of annexation.

 

SANITARY SEWER AND WATER:

 

1.  Water service could be provided by the existing 16" waterline along Hamilton Road or an 8" waterline on Beecher Crossing.  It is understood that any extension of water lines is the responsibility of the owner/developer.

 

2.  Sanitary sewer service is available from an 8" sanitary sewer adjacent to the east property on Beecher Crossing.

 

STREETS:

 

The owner/developer shall be responsible for the installation of internal street patterns, if any.  Upon acceptance of these improvements by the City of Gahanna, the City will be responsible for street and light maintenance.

 

The city agrees to maintain the entire roadway within the annexed territory for all publicly owned right of way area. 

 

SANITATION:

 

Upon being annexed to the City of Gahanna, the proposed annexation shall receive sanitation service as provided in Chapter 941 (Garbage and Refuse Collection) of the Codified Ordinances.

 

FIRE:

 

FIRST RESPONSE FROM:  Station 133 - Mifflin Township, 501 Beecher Road, Gahanna.  Approximate response times: 1 - 1 1/2 minutes.  Apparatus responding: Engine/Rescue 133.

Station 131 - Mifflin Township, 475 Rocky Fork Boulevard, Gahanna.  Approximate response times:  3 - 4 minutes.  Apparatus responding:  Engine 131 and or Medic 131, and Ladder 131.

 

SECOND RESPONSE FROM:  Station 121 - Plain Township, 9500 North Johnstown Road, New Albany.  Approximate response times: 5 - 6 minutes.  Apparatus responding: Engine, Medic, Rescue and/or Ladder 121.

 

Station 141 - Jefferson Township, 6767 Havens Corners Road, Blacklick.  Approximate response times: 5 - 6 minutes.  Apparatus responding: Engine 141; Medic 141.

 

Mifflin Township Division of Fire services all of the City of Gahanna for Paramedic/EMS patient care/transportation, fire protection, hazardous materials response, rescue and fire prevention duties such as investigation, education and inspections.  The department is comprised of 61 full-time and approximately 20 part-time, certified personnel.  There are three strategically located fire stations within the city limits and one in the unincorporated area of Mifflin Township.  Minimum manning is three personnel per fire and/or EMS unit.  The department anticipates no problem in providing fire or EMS protection to this area of annexation.

 

RIGHT OF WAY - ANNEXATION REQUIREMENT:

In accordance with the adopted Thoroughfare Plan of the City of Gahanna, Hamilton Road is designated as a major arterial roadway.  Per the City of Gahanna, COG Section 1109.02, a primary right-of-way shall be 100 feet.  To comply with the provisions of 121.05 of the Codified Ordinances of Gahanna, the right of way required on Hamilton Road shall be 50 feet east of the centerline of Hamilton Road. All right-of-way requirements for this proposed annexation will be fulfilled by the right-of-way acquisition process for the Hamilton Road widening project. Improvement No. 784.

 

Section 3.  Said services outlined in Section 2 above shall be provided within one year of being requested by the owner/developer.

 

Section 4.  If zoning to be applied for at the completion of this annexation process is clearly incompatible with current township zoning, a buffer will be provided.

 

Section 5.  That second reading of this ordinance is hereby waived.

 

Section 6.  That the Clerk of Council is hereby authorized and directed to deliver a copy of this legislation to the office of the Board of Commissioners of Franklin County within 72 hours of passage of the legislation.

 

Section 7.  That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation, and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
