TO AUTHORIZE THE MAYOR TO ENTER INTO CHANGE ORDER AMENDMENT WITH GUDENKAUF CORPORATION TO EXTEND THE FIBER OPTIC NETWORK IN THE INDUSTRIAL ZONE; TO SUPPLEMENTALLY APPROPRIATE FUNDS THEREFOR; AND TO DECLARE AN EMERGENCY

WHEREAS, Phase I of the City's fiber optic project in the Industrial Zone was awarded to Gudenkauf Corporation by ORD-0129-2011 and there is a new business just beyond where Phase 1 of the fiber optic project stopped that has requested we extend the fiber to them and the City wishes to extend it; and
WHEREAS, Gudenkauf Corp. installed the fiber optics and has presented a proposal to extend the fiber approximately 1,149 feet on Taylor Station Road and 176 feet on Claycraft Road, and funding is needed for this change order; and
WHEREAS, the need by this business is immediate and the City wishes to accommodate this existing business in this matter, and all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That funding in the amount of THIRTY THREE THOUSAND DOLLARS ($33,000) is hereby supplementally appropriated from the unencumbered, unappropriated balance of the Tax Increment Equivalent Fund - Eastgate TIF, to Account No. 224.343.5930, Transfer to General Fund.
Section 2. That funding in the amount of THIRTY THREE THOUSAND DOLLARS ($33,000) is hereby supplementally appropriated from the unencumbered, unappropriated balance of the General Fund to Account No. 101.145.5596, Engineering Capital Projects/Improvements, to cover the herein costs.
Section 3. That ORD-0001-2012, passed January 2, 2012, is hereby amended to reflect this supplemental appropriation.
Section 4. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
