TO AUTHORIZE THE MAYOR TO ENTER INTO EXTENDED CONTRACT WITH ADVANCED CIVIL DESIGN TO PERFORM ADDITIONAL SOIL TESTING AS REQUIRED BY THE BUREAU OF UNDERGROUND STORAGE TANK REGULATIONS (BUSTR) AT THE CITY OF GAHANNA FUEL SITE, 785 SCIENCE BOULEVARD; AND TO DECLARE AN EMERGENCY.

WHEREAS, ORD-0111-2011 authorized the demolition of the City of Gahanna Fuel Site at 785 Science Blvd. and the work has been completed; and
WHEREAS, during routine testing at the fuel site after the tanks were removed evidence of petroleum contaminated soil was found; and
WHEREAS, BUSTR has directed the City that additional soil testing must be performed to ensure that there is no groundwater contamination and report must be submitted to them; and
WHEREAS, the City Engineer has received proposal from Advanced Civil Design to complete the BUSTR Tier 1 delineation, which includes installing groundwater monitoring wells into bedrock, continuous sampling, and field monitoring, and has recommended we proceed with them for the work; and
WHEREAS, it is imperative to move forward with this ordinance as BUSTR is requiring immediate action, and all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into extended contract with ADVANCED CIVIL DESIGN, 422 Beecher Road, Gahanna, Ohio 43230, to perform additional soil testing as required by the Bureau of Underground Storage Tank Regulations at the Gahanna Fuel Site, 785 Science Boulevard; Proposal attached as EXHIBIT A, and made a part herein.
Section 2. That funding in the amount of SEVENTEEN THOUSAND SEVEN HUNDRED DOLLARS ($17,700) is available in Account No. 224.343.5596, TIZ, Development Capital Projects/Improvements, to cover the herein costs.
Section 3. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
