TO WAIVE REQUIREMENTS OF SECTION 1317.01, COMPLETION OF STREET REQUIRED BEFORE ISSUANCE OF BUILDING PERMIT; RELIEF, OF THE CODIFIED ORDINANCES OF THE CITY OF GAHANNA; FOR THE DEVELOPMENT KNOWN AS BERCLEY WOODS BY BERCLEY WOODS, LLC; AND TO DECLARE AN EMERGENCY.

WHEREAS, Bercley Woods, LLC, has requested relief from the requirements of Section 1317.01 of the Codified Ordinances; and

 

WHEREAS, the request is to build only the foundations before the streets are completed; and

 

WHEREAS, the developer is requesting the release of foundation permits for Phase I buildings which are 1, 8, 9 and 11, to complete the underslab mechanicals and pour the building slabs; and

 

WHEREAS, the City Engineer and Building Division have no concerns with this if Council waives the said requirements; and

 

WHEREAS, the Mifflin Township Fire Department has agreed with the request with certain stipulations; and

 

WHEREAS, due to the impending construction season it is imperative to move forward as quickly as possible, all for the preservation of the public peace, health, safety and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That this Council does hereby waive the requirements of Section 1317.01, Completion of Street Required before issuance of Building Permit; Relief, of the Codified Ordinance of the City of Gahanna for the Bercley Woods development; to allow release of foundation permits for buildings 1, 8, 9 and 11, as outlined in the Action Plan submitted and attached hereto as EXHIBIT A.

 

Section 2.  That a temporary roadway is in place to support the largest Mifflin Township Fire Department Vehicle, and will be maintained, and shall not be blocked with construction equipment.

 

Section 3.  That it is understood that building permits will not be issued until sufficiency of completion is determined by the Building Inspector and City Engineer.

 

Section 4.  That it is understood that occupancy permits will not be issued until sufficiency of completion is determined by the Building Inspector and City Engineer.

 

Section 5.  That, for reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
