AN ORDINANCE APPROVING AND AUTHORIZING THE EXECUTION AND DELIVERY OF A JOINT ECONOMIC DEVELOPMENT ZONE CONTRACT BY AND BETWEEN JEFFERSON TOWNSHIP AND THE CITY OF GAHANNA

WHEREAS, Jefferson Township (the "Township") and the City of Gahanna (the "City") desire to facilitate new and expanded growth of commercial and industrial development in the State of Ohio (the "State") and in the JEDZ (as hereinafter defined); and
WHEREAS, pursuant to Ohio Revised code Section 715.691, the Township and the City negotiated a Joint Economic Development Zone Contract (the "JEDZ Contract") creating the Gahanna-Jefferson Joint Economic Development Zone (the "JEDZ") encompassing the real property described and depicted in Exhibit A to the JEDZ Contract; and
WHEREAS, pursuant to Ohio Revised Code Section 715.691, the Township and the City each published a notice of the time and place of a public hearing regarding the JEDZ Contract to be held by the Township and the City, respectively, at least 30 days prior to their respective meeting; and
WHEREAS, since the publication of those notices, there has been on file with the Township Fiscal Officer and the Clerk of this Council: (i) a copy of the proposed JEDZ Contract, (ii) a description of the areas to be included in the JEDZ, including a map in sufficient detail to denote the specific boundaries of the JEDZ, and (iii) an economic development plan for the JEDZ that includes a schedule for the provision of any new, expanded, or additional services, facilities or improvements; and
WHEREAS, this Council held a public hearing on January 21, 2014, regarding the proposed JEDZ Contract that allowed public comment and recommendations regarding the JEDZ Contract;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, OHIO:
Section 1. The creation of the JEDZ pursuant to the JEDZ Contract, attached hereto as Exhibit A and incorporated herein by reference, will facilitate new and expanded growth for commercial and industrial development in the State and in the JEDZ.
Section 2. The economic development plan now on file with the Clerk of this Council is approved.
Section 3. The JEDZ Contract, attached hereto as Exhibit A and incorporated herein by reference, is approved and the Mayor is hereby authorized to sign and deliver that JEDZ Contract.
Section 4. The Mayor, the Clerk of this Council, the Finance Director and the City Attorney are authorized to execute and deliver such instruments and certificates, and to take such actions as are necessary to effect the creation of the JEDZ or to effect the provisions of the JEDZ Contract.
Section 5. All formal actions of this Council and any of its committees concerning and relating to the passage of this ordinance, and that all deliberations of this Council and of any committees that resulted in those formal actions, occurred in meetings open to the public in accordance with the law.
Section 6. That this ordinance shall be in full force and effect after passage by this Council and 30 days after date of signature approval by the Mayor.
