AN ORDINANCE REDESIGNATING THE COMMUNITY IMPROVEMENT CORPORATION OF GAHANNA AS THE AGENCY OF THE CITY OF GAHANNA, OHIO, AND AFFIRMING THE AGREEMENT WITH THE CORPORATION AS SUCH AGENCY UNDER SECTION 1724.10 OF THE REVISED CODE OF OHIO.

WHEREAS, Pursuant to Chapter 1724 of the Ohio Revised Code as it may hereafter be amended (herein called the "Act"), there has been formed a corporation known as the Community Improvement Corporation of Gahanna, a corporation not for profit as recorded on the records of incorporation and miscellaneous filing of the Secretary of the State of Ohio on the 10th day of October, 1965; and
WHEREAS. there are substantial and pressing problems, including but not limited to the development and encouragement of industry within the confines of the City of Gahanna, Ohio, which problems are best solved by the Corporation; and
WHEREAS, it is hereby found and determined that the policy of this City is to promote the health, safety, morals and general welfare of its inhabitants through the redesignation by ordinance of a Community Improvement Corporation as the agency of the City for industrial, economic, civic, commercial, distribution and research development in the City; and
WHEREAS, Substitute Ordinance 88-78 designated or redesignated the Community Improvement Corporation of Gahanna as the agency of the City of Gahanna; and
WHEREAS, this ordinance is required to allow such development to go forward, and to provide for the creation of jobs and employment within the City by way of commercial development; and
WHEREAS, any political subdivision which has designated a community improvement corporation as such agency may enter into an agreement with a said corporation to provide any one or more services specified by the Act;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Community Improvement Corporation of Gahanna is hereby redesignated as the agency of the City of Gahanna, Ohio, for the industrial, economic, civic, commercial, distribution and research development of the City of Gahanna, Ohio.
Section 2. That the agreement signed pursuant to Substitute Ordinance 88-78, attached hereto as EXHIBIT A, which agreement, executed by parties in 1978, constituted the plan of industrial, economic, civil, commercial, distribution and research development for the City of Gahanna, Ohio, is hereby incorporated herein by reference and is hereby approved and affirmed.
Section 3. This Council hereby finds and determines that all formal actions relative to the adoption of this ordinance were taken in an open meeting of this Council, and that all deliberations of this Council and of its committees, if any, which resulted in formal action, were taken in meetings open to the public, in full compliance with applicable legal requirements, including Section 121.22 of the Ohio Revised Code.
Section 4. This ordinance shall be in full force and effect upon passage by this Council and 30 days after date of signature approval by the Mayor.
