TO DECLARE THE NECESSITY AND INTENT TO APPROPRIATE REAL ESTATE IN CONNECTION WITH THE TAYLOR ROAD BOOSTER STATION TO ACQUIRE A 30' STRIP OF LAND ATTACHED TO LOT 121 OF RATHBURN WOODS, SECTION 4, 501 HELMBRIGHT ROAD; IMPROVEMENT NO. ST 1003.
BODY
WHEREAS, it is necessary to increase the capacity of the water supply system to the Industrial area, and the City Engineer has been working to find the appropriate site for a booster station; and
WHEREAS, the ideal location for the station is the Helmbright Drive detention basin, and there is a 30' devil's strip of land that the City wants to access for the booster station; and
WHEREAS, it is necessary to acquire those interests not already belonging to the City of Gahanna by Note "C" in plat book 68, Page 15 on all or part of the 20,842 square foot portion of lot 121 of Rathburn Woods, Section 4, as shown on the attached exhibit and also delineated on the said plat; and
WHEREAS, the devil's strip is attached to lot 121 of Rathburn Woods, Section 4, 501 Helmbright Drive, and it is better to access the site from Helmbright Drive rather than Taylor Road, so it is necessary to acquire the 30' strip from the owner of lot 121;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That this Council hereby declares the necessity and intent to appropriate certain real estate for purchase consisting of a 30' strip of land for the Taylor Road Booster Station, 501 Helmbright Drive; Improvement No. 1003; property attached to lot 121 of Rathburn Woods, Section 4; pursuant to and in accordance with the Codified Ordinances of the City of Gahanna, the Charter of the City of Gahanna, and the Constitution of the State of Ohio, Chapter 719 and Chapter 163, Ohio Revised Code, said parcel more particularly described in EXHIBIT A, attached to this resolution and made a part herein.
Section 2. That the City Attorney or his representative is hereby authorized and directed to cause a written notice of the adoption of this Resolution to be given to the owner/s/, person/s/, in possession of and person/s/ having a real or possible interest of record in the premises described in EXHIBIT A herein, and said notice shall be served by said City Attorney or his representative, who shall make return of said service of notice in the manner provided by law.
Section 3. That this Resolution shall be in full force and effect upon passage by this Council and 30 days from date of signature by the Mayor.
