TO AUTHORIZE THE MAYOR TO ENTER INTO AGREEMENT WITH THE OHIO DEPARTMENT OF TRANSPORTATION FOR FRA-MORSE ROAD-EAST PROJECT (PID 13897) WHICH PROPOSES TO DO STREET TREE PLANTING AND AREA-SPECIFIC LANDSCAPING WITHIN EXISTING RIGHT OF WAY; AND TO DECLARE AN EMERGENCY

WHEREAS, Ordinance No. 990492, passed October 18, 1999, enacted legislation for street tree planting and area-specific landscaping within existing Right-of-Way to enhance the FRA-Morse Road-East project (PID 13897); total work length of project being approximately 1.402; and

 

WHEREAS, The Director of Transportation has approved legislation proposing cooperation and has caused to be made plans and specifications and an estimate of cost and expense for improving the above described highway and has transmitted copies of the same to this legislative authority; and

 

WHEREAS, the City desires the Director of Transportation to proceed with the aforesaid highway improvement; and

 

WHEREAS, to expedite the highway project and to promote highway safety, it is imperative to move forward with this as quickly as possible all for the preservation of the public peace, health, safety and welfare:

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  The City agrees to assume and bear 100% of the entire cost of the improvement, less the amount of Federal-aid funds set aside by the Director of Transportation for the financing of this improvement from funds allocated by the Federal Highway Administration, U.S. Department of Transportation, and further, the City agrees to assume and bear 100% of the cost of Preliminary Engineering and Right-of-Way, excluding in-house preliminary engineering and Right-of-Way charges incurred by the State.

 

In addition, the City also agrees to assume and bear 100% of  the cost of any construction items requested by the City on the entire improvement, which are not necessary for the improvement, as determined by the State and Federal Highway Administration.

 

Section 2. That the City of Gahanna agrees to be lead agent for the project.

 

Section 3.  That FORTY FIVE THOUSAND DOLLARS ($45,000) was appropriated to Account No. 101.436.5548, Capital Projects, Landscape Board, and has been encumbered by Purchase Order No. 40960, and that ONE THOUSAND NINE HUNDRED TWENTY FOUR DOLLARS ($1,924) was appropriated in the 2001 Appropriations to Account No. 101.436.5548, Capital Projects, Landscape Board, and the fiscal officer is hereby authorized and directed to issue an order on the treasurer for said sum upon the requisition of the Director of Transportation to pay the cost and expense of said improvement.  The City of Gahanna hereby agrees to assume in the first instance, the share of the cost and expense over and above the amount to be paid from Federal funds.

 

Section 4.  That the City of Gahanna hereby requests the Director of Transportation to proceed with the aforesaid highway improvement.

 

Section 5.  That the Mayor is hereby authorized on behalf of the City of Gahanna to enter into contract with the Director of Transportation.

 

Section 6.  That the City will transmit to the Director of Transportation a fully executed copy of this Ordinance.

 

Section 7.  That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on the date of signature approval by the Mayor.
