AN ORDINANCE TO ACCEPT THE ENTRY BY THE BOARD OF COMMISSIONERS OF FRANKLIN COUNTY, RESOLUTION NO. 1169-97, "RESOLUTION TO APPROVE THE PETITION OF THE CITY OF GAHANNA OF 0.96+/- ACRES IN JEFFERSON TOWNSHIP TO THE CITY OF GAHANNA"; AND TO DECLARE AN EMERGENCY

WHEREAS, a Petition for the annexation of 0.96+/- acres from Jefferson Township to the City of Gahanna was duly filed under authorization and direction of Council; and
WHEREAS, a hearing on said Petition was heard before the Board of County Commissioners of Franklin County on December 16, 1997; and
WHEREAS, Section 709.16(b) provides: "If the only territory to be annexed is contiguous territory owned by the municipal corporation seeking annexation and if such territory is located entirely within the same county as the municipal corporation seeking annexation, upon receipt of the petition required by section 709.15 of the Revised Code, the board of county commissioners shall, by resolution, approve the annexation and make such adjustments of funds, unpaid taxes, claims, indebtedness, and other fiscal matters as the board determines to be proper. The annexation shall be complete upon the entry, pursuant to the board's resolution, of an order upon the journal of the board authorizing such annexation"; and
WHEREAS, in order to proceed with the orderly development of this newly annexed parcel, it is desirable and necessary to proceed to effect this acceptance at the earliest possible date, all for the preservation of the public peace, health, safety, and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That this Council, under authority of Section 709.16(b) of the Ohio Revised Code, hereby accepts the Entry of the Board of Commissioners of Franklin County to approve the annexation of 0.96+/- acres from Jefferson Township to the City of the City of Gahanna., said land also known as 810 East Johnstown Road.
Section 2. That said land is more particularly described in EXHIBIT A, attached hereto and made a part of this ordinance.
Section 3. That Gahanna Planning Commission is hereby requested to recommend to this Council a zoning category for this land.
Section 4. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation, and shall be in full force and effect immediately upon passage by this Council and approval by the Mayor.
