Title

 

TO AMEND CHAPTER 928, SEWER DISTRICTS GENERALLY, OF THE CODIFIED ORDINANCES OF GAHANNA; TO PROVIDE A DOLLAR CERTAIN PER ACRE FOR CONSTRUCTION; TO CREATE "TRIANGLE WEST SEWER DISTRICT."

 

Body

 

WHEREAS, a sizable number of parcels have been grouped into a project known as the triangle north area and certain parcels to the south; and

 

WHEREAS, the area is unsewered and will require sanitary sewer service for continued development; however, interest is being expressed in the western 66 acres of this district; and

 

WHEREAS, a new district "Triangle West Sewer District" needs to be created with its own terms, conditions and fees;  individual developments cannot feasibly extend sanitary sewer service to this district;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That Section 928.02, Triangle North Sanitary Sewer District, of Chapter 928, Sewer Districts Generally, of the Codified Ordinances of Gahanna, is hereby amended as follows:

 

928.02  TRIANGLE NORTH SANITARY SEWER DISTRICT.

There is hereby created an area known as the Triangle North Sanitary Sewer District for the purpose of constructing a sub trunk sewer to serve the district, and to recover the cost of said sewer by means of a per acre fee, as described herein, with said Triangle North Sanitary Sewer District more particularly described in EXHIBIT A and map as shown on NEW EXHIBIT B, with both exhibits attached to the original Ordinance No. 216-97.

 

a)  Fees.

The properties enclosed by the boundaries of the herein EXHIBIT A and NEW EXHIBIT B  which connect to the sub trunk sewer or tributaries and are developed in a commercial zoning, a multi-family zoning, or are platted subdivisions shall be assessed an acreage fee.  This fee shall be based on the actual cost of the sewer finances over a seven-year period with an interest rate of 8%.  Engineering economical analysis, assuming seven equal payments, yields a factor of 1.3447.  The capital recovery cost calculated is THUS  divided by the 142 acres in this district.  THE FEE THUS CALCULATED IS TO BE FOUR THOUSAND FOUR HUNDRED SEVENTY DOLLARS ($4,470) PER ACRE.  Fees are to be paid upon acceptance of connecting sewer or connection of service.

 

b)  Waivers.

The sub trunk footage fee defined in 921.05(b) of the Codified Ordinances shall be waived for properties connecting to the North Triangle sub trunk Sewer.

 

c)  Exceptions.

1.  Existing single family residences of lands zoned in the ER-1 or ER-2 are subject to the statutory front footage fees.

 

2.  Properties abating the sub trunk sewer may be exempted from the front footage fees as required in 921.05(a) of the Codified Ordinances in exchange for granting of easements for the said sewer.

 

3.  Exempted properties shall be subject to the fee if rezoned or redeveloped as specified herein.

 

 

Section 2.  That Section  928.03, Triangle West Sewer District, of Chapter 928, Sewer Districts Generally, is hereby enacted as follows:

 

.928.03  TRIANGLE WEST SEWER DISTRICT.

THERE IS HEREBY CREATED AN AREA KNOWN AS THE TRIANGLE WEST SEWER DISTRICT FOR THE PURPOSE OF CONSTRUCTING A sub trunk SEWER TO SERVE THIS DISTRICT, AND TO RECOVER THE COST OF SAID SEWER BY MEANS OF A PER ACRE FEE, AS DESCRIBED HEREIN, WITH SAID TRIANGLE WEST SEWER DISTRICT MORE PARTICULARLY DESCRIBED IN EXHIBIT C AND MAP AS SHOWN ON EXHIBIT D, ATTACHED TO THIS ORDINANCE AND MADE A PART HEREIN.

The properties enclosed by the boundaries of the herein EXHIBIT and EXHIBIT D  which connect to the sub trunk sewer or tributaries and are developed in a commercial zoning, a multi-family zoning, or are platted subdivisions shall be assessed an acreage fee.  This fee shall be based on the actual cost of the sewer finances over a seven-year period with an interest rate of 8%.  Engineering economical analysis, assuming seven equal payments, yields a factor of 1.3447.  The capital recovery cost calculated is to be divided by the 66 acres in this district.  Fees are to be paid upon acceptance of connecting sewer or connection of service.

 

b)  Waivers.

c)  Exceptions.

2.  Properties abating the sub trunk sewer may be exempted from the front footage fees as required in 921.05(a) of the Codified Ordinances in exchange for granting of easements for the said sewer.

Section 3.  That Chapter 928, Sewer Districts Generally, is hereby amended to reflect these changes and any ordinances or parts of ordinances in conflict herewith are hereby repealed.

 

Section 4.  That this ordinance shall be in full force and effect at the earliest period allowed by law.
