TO AUTHORIZE THE MAYOR TO ENTER INTO CONTRACT WITH HUNA DESIGNS, FOR CONSTRUCTION AND INSTALLATION OF A MODULAR SKATE PARK AT SHULL PARK; TO SUPPLEMENTALLY APPROPRIATE $200,000; AND TO DECLARE AN EMERGENCY.

WHEREAS, the City wishes to move forward with construction of a Skate Park; and

 

WHEREAS, it is to important to contract for the needed blacktop, which will be the biggest part of the project, to insure purchase price; and

 

WHEREAS, letter proposal has been received from Huna Designs and the  Director of Parks & Recreation has recommended that we proceed to enter into contract; and

 

WHEREAS, Senate Bill Sub. S.B. 24 became effective in October, 2001 and expanded the definition of governmental function in the Political Subdivision Sovereign Immunity Law to cover a recreational area or facility which includes skate park; and 

 

WHEREAS, it is imperative to move forward with this project due to the impending construction season, all for the preservation of the public peace, health, safety and welfare:

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Mayor is hereby authorized to enter into contract with HUNA DESIGNS, 1000 Buffalo Road, Lewisburg Pennsylvania, 17837, for construction and installation of a Skate Park at Shull Park, in accordance with City specifications. 

 

Section 2.  That funding in the amount of  TWO HUNDRED THOUSAND DOLLARS ($200,000) is hereby supplementally appropriated from the unencumbered, unappropriated balance of the General Fund to Account No. 101.431.5515, Capital Projects/Equipment Parks & Recreation.

 

Section 3.  That ORD-0001-2003, passed January 2, 2003, is hereby amended to reflect this supplemental appropriation.

 

Section 4.  That waiver of second reading has been requested.

 

Section 5.  That, for the reasons set forth in the preamble herein above, this ordinance shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
