TO ACCEPT 13.7+/- ACRES FROM JEFFERSON AND MIFFLIN TOWNSHIPS TO THE CITY OF GAHANNA, OHIO, REQUESTED BY LEASENET, INC., ET AL.

WHEREAS, an application for annexation of 13.7+\- acres from Jefferson and Mifflin Townships to the City of Gahanna, Ohio, has been duly filed and was granted by the Board of County Commissioners of Franklin County, Ohio, on August 5, 1998; and

 

WHEREAS, said application and all pertinent proceedings and transcripts have been held for a period of sixty (60) days by the Clerk of Council of the City of Gahanna, Ohio, pursuant to notice and according to law;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the application of LEASENET, INC., ET AL., requesting the annexation to the City of Gahanna of 13.7+/- acres, more particularly described in EXHIBIT A, hereto, which territory is contiguous to the City of Gahanna, as approved by the Board of County Commissioners of Franklin County, Ohio, on August 5, 1998, IS HEREBY ACCEPTED.

                                                                                                                                                                                         

Section 2.  That an accurate map of the territory, together with the petition for its annexation and other papers in relation thereto and a certified transcript of the proceedings of the Franklin County Board of County Commissioners in relation thereto have been on file with the Clerk of Council of the City of Gahanna for sixty (60) days prior to being presented to this Council ARE HEREBY ACCEPTED.

 

Section 3.  That all services are to be constructed by the owner and/or developer.

 

Section 4.  That in accordance with the adopted Thoroughfare Plan of the City of Gahanna, Hamilton Road and Morse Road are designated as a principal arterial roadways.  Pursuant to Section 1109.02 of  the Codified Ordinances of the City of Gahanna, a principal arterial right of way shall be 100 feet.  According to the documentation provided by the applicant, the present right of way on both roads is 60 feet from the center line at the property.  No additional right of way is be required.

 

Section 5.  That Gahanna Planning Commission is hereby requested to make a zoning recommendation to Council for this newly-annexed parcel.

 

Section 6.  That this ordinance shall be in full force and effect at the earliest period allowed by law.
