RESOLUTION TO DECLARE THE NECESSITY AND INTENT TO APPROPRIATE REAL ESTATE FOR THE PURPOSE OF A RETENTION BASIN; FOR PROPERTY LOCATED WEST OF HAMILTON ROAD ACROSS FROM TRESHAM ROAD; AND TO DECLARE ANY EMERGENCY.

WHEREAS, there has been a drainage problem in Gahanna Heights for some time and the City has been looking to build a retention basin to relieve this problem; and
WHEREAS, property is available through the proposed parkland for a new development in the area and the City is currently in negotiations with The Stonehenge Land Company to acquire the property; and
WHEREAS, it is imperative to move forward with this resolution in an expedient manner so that discussion can continue with The Stonehenge Land Company to acquire the property, and all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That this Council hereby declares the necessity and intent to appropriate a certain parcel of real estate to build a retention basin west of Hamilton Road and across from Tresham Road, consisting of 4.431 acres; pursuant to and in accordance with the Codified Ordinances of the City of Gahanna, the Charter of the City of Gahanna, and the Constitution of the State of Ohio, Chapter 719 and Chapter 163, Ohio Revised Code, said parcel more particularly described in EXHIBIT A, attached to this resolution and made a part hereof.
Section 2. That the City Attorney is hereby authorized and directed to cause a written notice of the adoption of this Resolution to be given to the owner/s/, person/s/, in possession of and person/s/ having a real or possible interest of record in the premises described in EXHIBIT A, herein and said notice shall be served by said City Attorney or his representative, who shall make return of said service of notice in the manner provided by law.
Section 3. That, for the reasons set forth in the preamble herein above, this resolution is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
