TO AUTHORIZE THE DIRECTOR OF FINANCE TO PAY MEMBERS OF THE NATIONAL GUARD AND RESERVES CALLED TO ACTIVE DUTY IN FEDERAL STATUS THE DIFFERENCE BETWEEN THEIR MILITARY SALARY AND THE BASE SALARY THEY RECEIVE AS A CITY OF GAHANNA EMPLOYEE; AND TO DECLARE AND EMERGENCY.

WHEREAS, with the events since the September 11, 2001 tragedy, many members of the National Guard and Reserves are being called to active duty for potential conflicts worldwide; and

 

WHEREAS, these City of Gahanna employees will not receive the same salary that they do at their current jobs, and it is a great deal less; and

 

WHEREAS, it is important that the City of Gahanna support these employees who are defending our freedom and our way of life; and

 

WHEREAS, the Administration has requested that the City make up the difference between the salary paid by the military and the base salary they receive as City employees; and

 

WHEREAS, this will only apply to those members of the National Guard and Reserves who are called up to active duty mobilization for an extended period of time to support the United States of America through January 31, 2005.

 

WHEREAS, it is imperative to move forward with this ordinance all for the preservation of the public peace, health, safety, and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO;

 

Section 1.  That the Director of Finance is hereby authorized to pay any City of Gahanna employees called to active duty mobilization for an extended period of time in a federal status to support the United States of America the difference between what the military would pay them and their base salary as a City employee.

 

Section 2.  That the funding to cover the salaries was appropriated in the 2003 Appropriations.

 

Section 3.  That this provision will apply to a call to active duty in a federal status through January 31, 2005.

 

Section 4.  That all affected employees will be offered health insurance under COBRA effective their last day worked with the City of Gahanna as health insurance will not be covered by the City of Gahanna, and there will be no pension accrual while they are on active duty unless required by law.

 

Section 5.  That this ordinance does not pertain to routine training in the National Guard or Reserves.

 

Section 6.  That for the reasons set forth in the preamble herein above this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
