TO AUTHORIZE THE MAYOR TO ENTER INTO CONTRACT WITH TOOLE AND ASSOCIATES FOR PLAN REVIEW, BACK-UP PERSONNEL AND INSPECTIONS; AND TO DECLARE AN EMERGENCY.

WHEREAS, to maintain certification by the State of Ohio Board of Building Standards, the City of Gahanna Building Department is required to have in its employ or under contract, alternate personnel to serve in the event of a conflict of interest or the unavailability of the building official, plans examiner or inspector; and
WHEREAS, since 2007, the Building Department has contracted with Asebrook & Co. Architects for back-up Ohio Certified Residential Building Official, back-up Residential Plans Examiner, back-up Residential Building Inspector, back-up Ohio Certified Building Official, back-up Ohio Certified Plans Examiner, and back-up Ohio Certified Building Official services; and
WHEREAS, Asebrooke has recently changed hands and at this time it is necessary for the City to enter into a contract with the new entity, Toole & Associates; and
WHEREAS, in order to maintain the annual renewal period already in place for all Building Department contracts, this initial contract with Toole & Associates will only extend through the end of 2015; and
WHEREAS, the only changes to the contract at this time are the contractor name and the mileage rate on the fee schedule which has increased since the last contract was enacted; and
WHEREAS, it is imperative to proceed with this Ordinance in order to not delay the payment of invoices to Toole & Associates, and all for the preservation of the public peace, property, health, safety and welfare.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized the enter into contract with Toole & Associates, 454 East Main Street, Suite 236, Columbus, Ohio 43215, for the plan review, back-up personnel and inspections; said contract attached to this Ordinance as EXHIBIT A, and made a part herein.
Section 2. That, for the reasons set forth in the preamble hereinabove, this Ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
