TO AMEND ORDINANCE NO. 970357, TO AUTHORIZE THE MAYOR TO ENTER INTO TWO MODIFICATIONS OF LETTER OF AGREEMENT WITH CITY OF COLUMBUS FOR A JOINT WATER LINE PROJECT ON MORSE ROAD FROM S.R. 62 TO REYNOLDSBURG-NEW ALBANY ROAD, IMPROVEMENT NO. 699; TO PROVIDE $138,429 FOR ENGINEERING SERVICES THERETO; AND TO DECLARE AN EMERGENCY.

WHEREAS, the Administration has requested authorization to enter into two modifications to the original Letter of Agreement with the City of Columbus, Ordinance No. 970357; and
WHEREAS, these modifications are required for the scope of design services and regarding the bidding and construction administration; and
WHEREAS, in order not to delay the construction of this important project, it is prudent and desirable, all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into "Modification No. 1 to the Letter of Agreement for Morse Road & Reynoldsburg-New Albany Road area 36-inch transmission Main," Improvement No. 699, between City of Gahanna and City of Columbus, said Modification No. 1 attached to this ordinance as EXHIBIT A, and made a part herein.
Section 2. That the Mayor is hereby authorized to enter into "Modification No. 2 to the Letter of Agreement for Morse Road & Reynoldsburg-New Albany Road area 36-inch transmission Main," Improvement No. 699, between City of Gahanna and City of Columbus, said Modification No. 2 attached to this ordinance as EXHIBIT B, and made a part herein.
Section 3. That ONE HUNDRED THIRTY-EIGHT THOUSAND FOUR HUNDRED TWENTY-NINE DOLLARS ($138,429) is hereby supplementally appropriated from the unappropriated, unencumbered balance of The Water Fund TO ACCOUNT NO. 651.350.5596, Capital Projects, Morse Road Water Line, to cover the herein costs of engineering services to be paid to M.S. Consultants as a result of the herein modifications.
Section 4. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and upon date of signature approval by the Mayor.
