TITLE

AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN AGREEMENT WITH CK CONSTRUCTION GROUP INC. FOR CONSTRUCTION MANAGER AT RISK SERVICES RELATED TO THE CREEKSIDE FLOOD MITIGATION AND PLAZA IMPROVEMENTS PROJECT (FA-20-01); AUTHORIZING SUPPLEMENTAL APPROPRIATIONS; WAIVING SECOND READING AND DECLARING AN EMERGENCY

BODY

 

WHEREAS, on June 20, 2023, City Council authorized the Mayor to enter into an agreement with Fishbeck for architectural and engineering services related to the Creekside Flood Mitigation and Plaza Improvements Project (FA-20-01); and

 

WHEREAS, the City issued a Request for Proposals on May 8, 2026, for Construction Manager at Risk services for the project and received six proposals, of which three firms were shortlisted and interviewed following an evaluation by City staff; and

 

WHEREAS, based on qualifications, experience, project approach, and cost, the Administration has identified CK Construction Group Inc. as the preferred firm to provide Construction Manager at Risk services; and

 

WHEREAS, the proposed agreement provides for preconstruction services, including construction budgeting, scheduling, and coordination with the design team, at a cost not to exceed $75,567; and

 

WHEREAS, a Guaranteed Maximum Price (GMP) for construction will be established during the preconstruction phase and presented to City Council for separate authorization through an amendment to the agreement; and

 

WHEREAS, a supplemental appropriation of $80,000 from the unencumbered, unappropriated balance of the Capital Improvement Fund is necessary to fully fund the preconstruction phase of the project; and

 

WHEREAS, the Administration recommends waiving second reading and declaring an emergency for the immediate preservation of the public peace, property, health, safety, and welfare to allow CK Construction Group Inc. to begin timely coordination with the design team regarding project budgeting, scheduling, and construction logistics to ensure alignment with the project's goals and overall budget.

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:

 

Section 1. The Mayor is hereby authorized to enter into an agreement with CK Construction Group Inc., located at 500 Olde Worthington Road, Suite 200, Westerville, Ohio 43082, for Construction Manager at Risk services related to the Creekside Flood Mitigation and Plaza Improvements Project (FA-20-01), with Phase I preconstruction services in an amount not to exceed $75,567; said agreement attached hereto as EXHIBIT A and incorporated herein. Authorization of Phase II construction services and the associated Guaranteed Maximum Price shall be subject to subsequent approval by City Council.

 

Section 2. A supplemental appropriation in the amount of $80,000 is hereby authorized from the unencumbered, unappropriated balance of the Capital Improvement Fund (3250) to Account 325.06.550.5505 - Capital Improvement Capital Projects, to fund preconstruction services associated with the project.

 

Section 3. Council hereby waives the second reading of this ordinance.

 

Section 4. That, for the reasons set forth in the preamble hereto, this Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, property, health, safety, and welfare, and, upon receiving the affirmative vote required by Section 4.15 of the Charter, shall take effect immediately upon approval by the Mayor, or as otherwise provided by Section 4.14 of the Charter.
