TITLE
AN ORDINANCE WAIVING THE FORMAL BIDDING REQUIREMENTS PURSUANT TO GAHANNA CODE SECTION 133.02(c)(6), AUTHORIZING THE MAYOR TO ENTER INTO CONTRACT WITH ___________ FOR THE REPLACEMENT OF THE BIG WALNUT TRAIL BRIDGE DECKING; AND WAIVING SECOND READING
BODY
WHEREAS, the City of Gahanna maintains the Big Walnut Trail, a key component of the City’s recreational and pedestrian network; and
WHEREAS, a recent inspection of the trail bridges near Stonybrook Church off Johnstown Road revealed that the existing timber decking is showing significant signs of rot and mold growth, with deterioration progressing rapidly; and
WHEREAS, although temporary surface repairs have been made, and a third-party inspection has determined that the affected areas do not pose an immediate safety risk, full replacement of both bridge decks is required to ensure continued safe use of the trail system; and
WHEREAS, emergency procurement of materials and labor is necessary due to the immediate need to address these safety concerns; and
WHEREAS, pursuant to Gahanna Code Section 133.02(c)(6), the City Council may waive the formal advertising and bidding requirements when emergency conditions exist that require immediate action; and
WHEREAS, in lieu of formal bidding, the Parks & Recreation Department has solicited a minimum of three (3) quotes for both materials and labor for this project, and has recommended _______________ as the qualified vendor; and
WHEREAS, sufficient funds for this project are available in the Capital Improvement Fund (Account 3250.6550.5505).
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That this Council hereby waives the competitive bidding requirements pursuant to Gahanna Code Section 133.02(c)(6) due to emergency conditions requiring the immediate replacement of the Big Walnut Trail bridge decking.
Section 2. That this Council hereby authorizes the Mayor to enter into contract with ________________________, whose principal business address is ________________________, for the replacement of the Big Walnut Trail bridge decking, pursuant to the terms and conditions substantially set forth in EXHIBIT A, attached hereto and incorporated herein by reference.
Section 3. That the cost of this project shall be paid from the Capital Improvement Fund (Account 3250.6550.5505).
Section 4. That the second reading is hereby waived.
Section 5. That pursuant to City Charter Section 4.14, whereas the 30-day referendum period does not apply for ordinances authorizing and executing a construction contract, this Ordinance shall be in full force and effect immediately upon passage by this Council and on the date of signature of approval by the Mayor.
