WHEREAS, the State has identified the need for the described project as follows:

 

This project proposes to improve the intersection of US62 and CR17 (Morse Road) by adding turn and additional lanes for future traffic with ODOT to fund deck replacement/widening on US62 bridge only with project limits to extend approximately 1500 feet on each approach of the intersection of US62 and CR17; and

 

WHEREAS, to expedite the highway project and to promote highway safety, it is imperative to move forward with this as quickly as possible all for the preservation of the public peace, health, safety and welfare.

 

NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  Consent Statement:  Being in the public interest, the City of Gahanna gives consent to the Director of Transportation to complete the above described project.

 

Section 2.  Cooperation Statement:  The City of Gahanna shall cooperate with the Director of Transportation in the above described project as follows:

 

The City of Gahanna agrees to be the lead agency for Franklin County, the City of Columbus and the Village of new Albany for this project.

 

The City of Gahanna will assume and bear one hundred percent of the costs of preliminary development, final design and right-of-way acquisition.  Further, the City of Gahanna will assume and bear one hundred percent of the costs of construction less the federal and state dollars set aside for the improvement.

 

In the event the City of Gahanna, Franklin County, the City of Columbus or the Village of New Albany requests certain features or appurtenances  included within the State's highway improvement project's design and construction, and which features and appurtenances are determined by the State and FHWA to be not necessary for the State's project, the City of Gahanna shall contribute one hundred percent of the cost of those items.

 

The City hereby agrees to cooperate with the Director of Transportation of the State of Ohio in the planning, design and construction of the identified highway improvement project and grants consent to the Ohio Department of Transportation for its development and construction of the project in accordance with plans, specifications and estimates as approved by the Director.

 

Section 3.  Utilities and Right-of-Way Statement:  The City of Gahanna agrees that all right-of-way required for the described project will be acquired and/or made available in accordance with current State and Federal regulations.  The City of Gahanna also understands that right-of-way costs include eligible utility costs.

 

The City of Gahanna agrees that all utility accommodation, relocation and reimbursement will comply with the current provisions of 23 CFR 645 and the ODOT Utilities Manual.

 

Section 4:  Maintenance:  The City of Gahanna shall maintain the right-of-way and keep it free of obstructions, and hold said right-of-way inviolate for public highway purposes.

 

Section 5.  Authority to Sign:  The Mayor of Gahanna is hereby empowered on behalf of the City of Gahanna to enter into contracts with the Director of Transportation necessary to complete the above described project.

 

Section 6.  That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
