TO AUTHORIZE THE MAYOR TO ENTER INTO CONTRACT AND APPROVE THE FINAL RESOLUTION WITH THE OHIO DEPARTMENT OF TRANSPORTATION FOR FRA-TECHCENTER DRIVE EXTENSION, PID NUMBER 80722; ALSO KNOWN AS THE TECHCENTER DRIVE WEST IMPROVEMENT NO. 762; TO AUTHORIZE PAYMENT TO ODOT FOR THE CITY'S PORTION OF THE PROJECT; TO SUPPLEMENTALLY APPROPRIATE $1,802,972; AND TO DECLARE AN EMERGENCY.

WHEREAS, ORD-0002-2006 authorized preliminary legislation to cooperate with the Director of Transportation for the TechCenter Drive West Improvement No. 762; and
WHEREAS, before the project can begin the City of Gahanna must pass legislation required by ODOT as well as a Final Resolution; and
WHEREAS, the Director of Transportation has approved said legislation proposing cooperation and has caused to be made plans and specifications and an estimate of cost and expense for improving the above described highway and has transmitted copies of the same to this legislative authority; and
WHEREAS, the estimated share of the cost for the City is $1,802,972 and is to be paid to ODOT by December 30, 2010; and
WHEREAS, it is imperative to enter into Contract and approve Final Resolution with ODOT and have payment to them by the December deadline so that the project can continue on schedule with construction beginning in the Summer of 2011, and all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the City of Gahanna shall cooperate with the Director of Transportation in the above described project as follows:
The City agrees to assume and bear one hundred percent (100%) of the entire cost of the improvement, less the amount of Federal-aid funds set aside by the Director of Transportation for the financing of this improvement from funds allocated by the Federal Highway Administration, U.S. Department of Transportation and further, the City agrees to assume and bear one hundred percent (100%) of the cost of Preliminary Engineering and Right-of-way less the amount of Federal-aid funds set aside by the Director of Transportation for the financing of this improvement and less in-house preliminary engineering charges incurred by the State.
The share of the cost of the City is now estimated in the amount of $1,802,972, but said estimated amount is to be adjusted in order that the LPA's ultimate share of said improvement shall correspond with said percentages of actual costs when said actual costs are determined.
Section 2. That the Director of Transportation has approved said legislation proposing cooperation and has caused to be made plans and specifications and an estimate of cost and expense for improving the above described highway and has transmitted copies of the same to this legislative authority.
Section 3. That the City of Gahanna desires the Director of Transportation to proceed with the aforesaid highway improvement.
Section 4. That funding in the amount of ONE MILLION FIVE HUNDRED SEVENTY ONE THOUSAND FIVE HUNDRED SEVENTY SEVEN DOLLARS ($1,571,577) is hereby supplementally appropriated from the unencumbered, unappropriated balance of the Capital Improvements Fund to Account No. 325.122.5513, Capital Projects/Streets, to cover the herein costs.
Section 5. That funding in the amount of TWO HUNDRED THIRTY ONE THOUSAND THREE HUNDRED NINETY FIVE DOLLARS ($231,395) is hereby supplementally appropriated from the unencumbered, unappropriated balance of the WSCI Fund to Account No. 652.351.5596, Capital Projects/Improvements, to cover the herein costs.
Section 6. That ORD-0001-2010, passed January 2, 2010, is hereby amended to reflect this supplemental appropriation.
Section 7. That the City of Gahanna enter into a Contract with the State, and the Mayor be authorized to execute said Contract, and approve the Final Resolution, providing for the payment of the City the sum of money set forth herein above for improving the described project; Contract and Final Resolution attached as EXHIBIT A, and made a part herein.
Section 8. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
