TO AUTHORIZE THE MAYOR TO ENTER INTO CHANGE ORDER AGREEMENT WITH PARK ENTERPRISE CONSTRUCTION FOR HAMILTON ROAD SANITARY SEWER REPLACEMENT; IMPROVEMENT NO. 987; AND TO DECLARE AN EMERGENCY.

WHEREAS, ORD-0243-2011 authorized contract with Park Enterprise Construction for sanitary sewer line repairs along Hamilton Road; and
WHEREAS, when the sanitary sewer line was exposed it was found that the sewer had been installed with improper bedding which caused improper settlement of the line and it must be replaced; and
WHEREAS, proposal has been received from Park Enterprise Construction to remove the existing sanitary sewer piping, install new pipe and connect to laterals, and other related work, and the Director of Public Service has recommended we proceed with them for this additional work; and
WHEREAS, it is imperative to move forward with this legislation so that the sanitary sewer replacement can be completed as soon as possible, and all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is authorized to enter into Change Order Agreement with PARK ENTERPRISE CONSTRUCTION, 560 Barks Road West, Marion, Ohio 43302, for the Hamilton Road Sanitary Sewer Replacement, Improvement No. 987; proposal attached as EXHIBIT A and made a part herein.
Section 2. That funding in the amount of ONE HUNDRED FIVE THOUSAND FOUR HUNDRED FOURTEEN DOLLARS ($105,414) is hereby supplementally appropriated from the unencumbered, unappropriated balance of the SSCI Fund, to Account No. 662.361.5596, Sewer Capital Improvements/Capital Projects, to cover the here in costs.
Section 3. That ORD-0001-2012, passed January 2, 2012, is hereby amended to reflect this supplemental appropriation.
Section 4. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
