TO ACCEPT THE ANNEXATION OF 0.849+/- ACRES FROM JEFFERSON TOWNSHIP TO THE CITY OF GAHANNA, OHIO, PROPERTY LOCATED AT 4300 N. HAMILTON ROAD; REQUESTED BY HARRISON W. SMITH, JR., AGENT FOR PETITIONERS GARY L. AND TRENA M. ENGLAND.

WHEREAS, an application for annexation of 0.849+/- acres from Jefferson Township to the City of Gahanna, Ohio, has been duly filed and was granted by the Board of County Commissioners of Franklin County, Ohio, on October 3, 2001; and
WHEREAS, said application and all pertinent proceedings and transcripts have been held for a period of sixty (60) days by the Clerk of Council of the City of Gahanna, Ohio, pursuant to notice and according to law;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the application of GARY L. AND TRENA M. ENGLAND, by Harrison W. Smith, Agent, requesting the annexation to the City of Gahanna of 0.849+/- acres, more particularly described in EXHIBIT A, hereto, which territory is contiguous to the City of Gahanna, as approved by the Board of County Commissioners of Franklin County, Ohio, on October 3, 2001, IS HEREBY ACCEPTED.
Section 2. That an accurate map of the territory, together with the petition for its annexation and other papers in relation thereto and a certified transcript of the proceedings of the Franklin County Board of County Commissioners in relation thereto have been on file with the Clerk of Council of the City of Gahanna for sixty (60) days prior to being presented to this Council and are hereby accepted.
Section 3. That all services are to be constructed by the owner and/or developer.
Section 4. That in accordance with the adopted Thoroughfare Plan of the City of Gahanna, Hamilton Road is designated as a major arterial roadway. Pursuant to Section 1109.02 of the Codified Ordinances of the City of Gahanna, a major arterial right of way shall be 100 feet. To comply with the provisions of 121.05 of the Codified Ordinances of the City of Gahanna, the additional right of way required on Hamilton Road is 20 feet, making the right of way line 50 feet from centerline. The applicant has delivered to the City of Gahanna a Warranty Deed to satisfy the right of way requirement.
Section 5. That a zoning application has been filed with the Zoning Office for this newly-annexed parcel.
Section 6. That this ordinance shall be in full force and effect after passage by this Council and 30 days after signature of approval by the Mayor.
