TO AUTHORIZE THE DIRECTOR OF PUBLIC SERVICE TO AWARD AND THE MAYOR TO ENTER INTO CONTRACT WITH THE SHELLY COMPANY FOR THE HAVENS CORNERS ROAD/HELMBRIGHT INTERSECTION IMPROVEMENTS; IMPROVEMENT NO. 794; AND TO DECLARE AN EMERGENCY.

WHEREAS, bids were accepted for the Havens Corners/Helmbright Intersection Improvements on May 17, 2002; and
WHEREAS, the lowest and best bidder has been selected by the Director of Public Service with concurrence of the City Engineer; and
WHEREAS, the City has determined to go with The Shelly Company; and
WHEREAS, it is imperative to move forward with this project due to construction time remaining this year, all for the preservation of the public peace, health, safety, and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA:
Section 1. That the Mayor is hereby authorized to enter into contract with THE SHELLY COMPANY, P.O. Box 266, Thornville, OH 43076, for the Havens Corners/Helmbright intersection improvements, Improvement No. 794, in accordance with bid and city specifications, bid tab attached as EXHIBIT A.
Section 2. That funding in the amount of ONE HUNDRED SIXTY FIVE THOUSAND FIVE HUNDRED DOLLARS ($165,500) was appropriated in the 2002 Appropriations to Account No. 325.122.5548, Capital Improvement Fund, to cover the costs.
Section 3. That funding in the amount of TWO HUNDRED SEVENTEEN THOUSAND DOLLARS ($217,000) is hereby supplementally appropriated from the unappropriated unencumbered balance in the General Fund to Account No. 101.145.5541, Capital Project/Streets, to further cover the herein costs.
Section 4. That Ord-0001-2002, passed January 2, 2002, is hereby amended to reflect this supplemental appropriation.
Section 5. That for the reasons set forth in the preamble herein above this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
