TO AMEND THE CONTRACT WITH NICKOLAS SAVKO & SONS FOR THE CLAYCRAFT/MORRISON ROAD DRAINAGE PROJECT, IMPROVEMENT NO. 859; AND TO DECLARE AN EMERGENCY.

WHEREAS, the 2003 storm event flooded the Kahiki Plant while it was under construction and new plans are complete for a storm sewer to divert the flood flows past the plant; and

 

WHEREAS, the project is on property owned by the City and leased to the Kahiki; and

 

WHEREAS, the City Engineer recommends we amend the existing contract approved by ORD-0226-2005 to secure prices already under contract with the Morrison Road project contractor; and

 

WHEREAS, the work was included in the 2006 appropriations but was only funded to the level that the storm water fund had available; and

 

WHEREAS, with the use of bond proceeds on other projects and the release of storm water funds, additional money is available for this work; and

 

WHEREAS, it is imperative to move forward with this legislation so that work can begin this year, all for the preservation of the public peace, health, safety and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Mayor is authorized to enter into amendment to the contract with NICKOLAS SAVKO & SONS, 4636 Shuster Road, Columbus, Ohio 43214, for the Claycraft/Morrison Road Drainage Project, said amendment attached hereto as EXHIBIT A.

 

Section 2.  That funding in the amount of ONE HUNDRED TWENTY FIVE THOUSAND DOLLARS ($125,000) was set aside in the 2006 Appropriations to Account No. 631.350.5596, Capital, Miscellaneous Storm Improvements.

 

Section 3.  That funding in the amount of ONE HUNDRED SEVENTY FOUR THOUSAND FOUR HUNDRED DOLLARS ($174,400) is  hereby supplementally appropriated from the unencumbered,, unappropriated balance of the Stormwater Fund to Account No. 631.350.5596, Capital, Miscellaneous Storm Improvements.

 

Section 4.  That ORD-0001-2006, passed January 2, 2006, is hereby amended to reflect this supplemental appropriation.

 

Section 5.  That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
