TITLE
AN ORDINANCE TO AMEND ORD-0052-2023 AND ORD-0053-2023 AUTHORIZING THE CITY ATTORNEY TO FILE APPROPRIATIONS FOR PROPERTIES CONNECTED WITH THE TAYLOR STATION AND CLAYCRAFT ROUNDABOUT PROJECT TO CORRECT THE EFFECTIVE DATES; WAIVING SECOND READING, AND DECLARING AN EMERGENCY
BODY
WHEREAS, On July 24, 2023, Council adopted two ordinances authorizing the City Attorney to file an appropriation for right-of-way and temporary construction easements for two properties in furtherance of the Taylor Station and Claycraft Road Roundabout Project (ORD-0052-2023 and ORD-0053-2023); and
WHEREAS, the two ordinances inadvertently contained language within the effective date section that declared as follows: “Section 2. That this Ordinance shall be in full force and effect upon passage by this Council and on date of signature of approval by the Mayor.”; and
WHEREAS, it is necessary to amend each ordinance to reflect the correct effective date section to be 30 days after the signature of approval by the Mayor; and
WHEREAS, due to the timing of the ordinances, this amendment to correct the effective date sections is requested to be passed with waiver of second reading and passed as an emergency measure immediately necessary for the preservation of public peace, safety, health, and welfare of the City in order to resolve this clerical error.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That both ORD-0052-2023 and ORD-0053-2023 are hereby amended to strike Section 2: “That this Ordinance shall be in full force and effect upon passage by this Council and on date of signature of approval by the Mayor” and insert in the same Section 2: “That this Ordinance shall be in full force and effect after passage by this Council and 30 days after date of signature of approval by the Mayor.”
Section 2. That this amendment is made retroactive to July 24, 2023.
Section 3. That for the reasons set forth in the preamble, the second reading is hereby waived and this Ordinance is declared an emergency which shall be in full force and effect immediately upon passage by this Council and on date of signature of approval by the Mayor.
