TO ACCEPT 4.1+/- ACRES FROM JEFFERSON AND MIFFLIN TOWNSHIPS TO THE CITY OF GAHANNA, OHIO, REQUESTED BY CITY OF GAHANNA, ET AL

WHEREAS, an application for annexation of 4.1+\- acres from Jefferson and Mifflin Townships to the City of Gahanna, Ohio, has been duly filed and was granted by the Board of County Commissioners of Franklin County, Ohio, on August 4, 1999; and
WHEREAS, said application and all pertinent proceedings and transcripts have been held for a period of sixty (60) days by the Clerk of Council of the City of Gahanna, Ohio, pursuant to notice and according to law;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the application of CITY OF GAHANNA, ET AL., requesting the annexation to the City of Gahanna of 4.1+/- acres, more particularly described in EXHIBIT A, hereto, which territory is contiguous to the City of Gahanna, as approved by the Board of County Commissioners of Franklin County, Ohio, on August 4, 1999, IS HEREBY ACCEPTED.
Section 2. That an accurate map of the territory, together with the petition for its annexation and other papers in relation thereto and a certified transcript of the proceedings of the Franklin County Board of County Commissioners in relation thereto have been on file with the Clerk of Council of the City of Gahanna for sixty (60) days prior to being presented to this Council ARE HEREBY ACCEPTED.
Section 3. That all services are to be constructed by the owner and/or developer.
Section 4. In accordance with the adopted Thoroughfare Plan of the City of Gahanna, Hamilton Road is designated as a major arterial roadway. Pursuant to Section 1109.02 of the Codified Ordinances of the City of Gahanna, a primary right of way shall be 100 feet to comply with the provisions of Chapter 121.05 of the Codified Ordinances of Gahanna. The property proposed to be annexed is roadway right of way. The annexation is sponsored by the City at the request of the county to correct discontinuity of the corporate boundaries left by previous annexations. No additional right of way dedication is recommended.
Section 5. That this ordinance shall be in full force and effect after passage by this Council and upon the 30th day following the date of signature of approval by the Mayor.
