APPROVING THE SUBMISSION OF A TAX INCENTIVE REVIEW COUNCIL REPORT TO THE DIRECTOR OF DEVELOPMENT OF THE STATE OF OHIO; TO WAIVE SECOND READING; AND TO DECLARE AN EMERGENCY

WHEREAS, a Tax Incentive Review Council (the TIRC) was established pursuant to Section 5709.85 of the Ohio Revised Code to review annually the compliance of all agreements involving the granting of exemptions for commercial or industrial real property improvements under the Community Reinvestment Area (CRA) Program and make recommendations to the City Council as to continuing, modifying or terminating each CRA agreement in effect based upon the performance of the agreement; and

 

WHEREAS, the TIRC on March 8, 2001 has received and investigated said CRA Report and has found and determined that said report has satisfied all of the requirements of the CRA agreement; and

 

WHEREAS, the TIRC has returned a favorable recommendation for continuation of all CRA agreements; and

 

WHEREAS, said report is due to the Director of Development of the State of Ohio by March 31, 2001 and thereby necessitates the waiving of second reading of this legislation, all for the preservation of the public peace, health, safety and welfare; 

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That City Council hereby finds and determines that the establishment of CRA's has improved the economic climate of the City and influenced development and redevelopment of an area that has not enjoyed sufficient investment from new construction or remodeling of existing facilities.

 

Section 2.  That City Council accepts this annual review of the TIRC and agrees to continue said tax exemption agreements.

 

Section 3.  That said report is attached to this ordinance as EXHIBIT A.

 

Section 4.  That the Clerk of Council be and she hereby is directed to provide a certified copy of this Ordinance to the Director of Development of the State of Ohio as proposed by Administrative Rule 122:4-1-08 immediately following its passage and approval.

 

Section 5.  That all formal actions relative to the passage of this Ordinance were taken in an open meeting of this Council, that all deliberations of this Council and of its committees, if any, which resulted in formal action were taken in meetings open to the public, in full compliance with the applicable legal requirements, including Section 121.11 of the Ohio Revised Code.

 

Section 6.  That second reading of this ordinance is hereby waived.

 

Section 7.  That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
