TO AUTHORIZE THE MAYOR TO ENTER INTO AGREEMENT WITH SHEPHERD CHURCH OF THE NAZARENE FOR THE PURCHASE OF 7+/- ACRES OF LAND OWNED BY THE CHURCH AT 425 SOUTH HAMILTON ROAD; TO SELL 8.40 ACRES OF LAND OWNED BY THE CITY ADJACENT TO THE CHURCH PROPERTY; AND TO DECLARE AN EMERGENCY.

WHEREAS, negotiations have been ongoing for approximately a year for an exchange of property between the City of Gahanna and Shepherd Church of the Nazarene; and

 

WHEREAS, appraisals have been done during this time of negotiations which establish the market value of the land with the church's land appraised at $7,500 per acre and the City owned land being appraised at $15,000 per acre; and

 

WHEREAS, the church will donate to the City 2.54+/- acres to satisfy the requirement of the zoning approved in 1996; and

 

WHEREAS, as in the case of all real estate matters, time is of the essence, and it has been determined that the City must proceed immediately to effect this exchange for the orderly growth and development of the church, and for the preservation of the public peace, health, safety, and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Mayor is hereby authorized to purchase 7.00+/- acres from Shepherd Church of the Nazarene, as outlined in the proposal attached to this ordinance as EXHIBIT A.

 

Section 2.  That the Mayor is hereby authorized to sell 8.4+/- acres to Shepherd Church of the Nazarene, as outlined in the proposal attached to this ordinance as EXHIBIT A.

 

Section 3.  That at time of closing for this land exchange, a deed for 2.54+/- acres of land will be given to the City to satisfy the park land dedication requirements of the zoning approved in 1996.

 

Section 4.  That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
