AN ORDINANCE AMENDING ORDINANCE NO. 0027
2025 TO CORRECT THE ADDRESS FOR CENTERPOINT CHURCH FROM 670 MCCUTCHEON ROAD TO 620 MCCUTCHEON ROAD, SUBSTITUTING EXHIBIT B WITH A CORRECTED EXHIBIT B, AND DECLARING THIS ACTION TO BE A CORRECTION FOR THE RECORD
BODY

WHEREAS, the City of Gahanna previously adopted Ordinance No. 00272025 (the “Original Ordinance”) authorizing the Mayor to enter into an Access Easement Agreement with CenterPoint Church and appropriating funds for a Supplemental Agreement; and

WHEREAS, the title, body, and EXHIBIT B of the Original Ordinance incorrectly listed the address for CenterPoint Church as 670 McCutcheon Road (an address that correctly corresponds to Sunpoint Park), while the correct address for CenterPoint Church is 620 McCutcheon Road; and

WHEREAS, EXHIBIT A to the Original Ordinance was correct and requires no change; and

WHEREAS, the City Council desires to amend the Original Ordinance for the limited purpose of correcting the erroneous address and substituting EXHIBIT B with a corrected EXHIBIT B so that the public record accurately reflects the parties and property involved.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO, THAT:

Section 1. Ordinance No. 00272025 is hereby amended solely to correct the address for CenterPoint Church from “670 McCutcheon Road” to “620 McCutcheon Road” wherever it appears in the title, body, and EXHIBIT B of the Original Ordinance. This amendment does not change any other substantive term, condition, payment amount, or obligation contained in the Original Ordinance.

Section 2. Section 1 of the Original Ordinance is hereby amended and shall read in its entirety as follows (new wording shown):

Section 1. The Mayor is hereby authorized to enter into an Access Easement Agreement with CenterPoint Church, in a form acceptable to the City Attorney, for the use of the church’s parking lot located at 620 McCutcheon Road, Gahanna, Ohio, for a period of twenty (20) years; said Agreement attached hereto as EXHIBIT A and incorporated herein.


Section 3. Section 2 of the Original Ordinance is hereby amended only to reference the substituted EXHIBIT B (Corrected) and shall read in its entirety as follows (new wording shown):

Section 2. There is hereby appropriated the sum of One Hundred Fifty Thousand Dollars ($150,000) from the unappropriated and unencumbered balance of the Capital Improvement Fund (Fund 3250) to Account 325.06.550.5515 - Land Acquisition, for the purpose of making the first payment under the Supplemental Agreement attached hereto as EXHIBIT B (Corrected) and incorporated herein.

 

Section 4. EXHIBIT A to the Original Ordinance is confirmed to be correct and remains unchanged.

Section 5. EXHIBIT B to the Original Ordinance is hereby superseded and replaced in full with EXHIBIT B (Corrected), attached hereto and incorporated herein by reference. The substituted EXHIBIT B (Corrected) contains the correct address for CenterPoint Church as 620 McCutcheon Road and memorializes the same Supplemental Agreement terms and payment identified in the Original Ordinance. (EXHIBIT B (Corrected) is attached to and made part of this amending ordinance.)

Section 6. All other provisions of Ordinance No. 00272025 not inconsistent with this Ordinance shall remain in full force and effect. This Ordinance is intended solely to correct the public record and shall not be construed to create any new rights, obligations, or expenditures beyond those already authorized by the Original Ordinance.

Section 7. This Ordinance is corrective in nature and shall be in full force and effect after passage by this Council and 30 days after signature of approval by the Mayor.
