AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A CONTRACT WITH S&ME, INC., FOR ENGINEERING & DESIGN SERVICES FOR CHERRYBOTTOM ROAD SLOPE STABILIZATION AREAS 1 AND 2; WAIVING SECOND READING; AND DECLARING AN EMERGENCY.

WHEREAS, a roadway shoulder in multiple locations along Cherrybottom Road has been affected by unstable soil which has caused bank erosion; and
WHEREAS, the worsening conditions will impact the roadways if not addressed immediately; and
WHEREAS, the Public Service & Engineering Department sought scope proposals for the design of stabilization measures; and
WHEREAS, of the proposals, S&ME, INC. was the most qualified of the respondents; and
WHEREAS, included as part of the proposal is a Jurisdictional Waters Delineation for Academy Park, which will provide needed information in determining available locations for a biking skills course that the Department of Parks & Recreation is exploring; and
WHEREAS, it is imperative to proceed with this Ordinance for the preservation of the public peace, property, health, safety, and welfare.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into contract with S&ME Inc., 6190 Enterprise Ct., Dublin, Ohio, 43016, to perform preliminary engineering & design services for the Cherrybottom Road Slope Improvement Areas 1 and 2 project; said Contract attached as EXHIBIT A, and made a part herein.
Section 2. That funding in the amount of one hundred twenty-six thousand one hundred dollars ($126,100.00) is available in Account No. 325.06.550.5505, from 2021 appropriations to cover the herein costs; and two thousand one hundred dollars ($2,100) is available in Account No. 101.08.310.5205 (Parks Contract Services) to cover the herein costs.
Section 3. The second reading is hereby waived.
Section 4. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
