WHEREAS, the City Engineer, on September 21, 2012 filed with the Clerk of Council plans, specifications, profiles and a cost estimate for the construction of the Triangle East Sanitary Sewer, Imp. No. SA-871, Phase 1, said filing in accordance with Section 727.12 of the Ohio Revised Code and pursuant to Council request by SR-0001-2012; and

 

WHEREAS, the extension of this sanitary sewer line is mandated immediately for the preservation of the public peace, property, health, safety and welfare;

 

NOW, THEREFORE, BE IT RESOLVED THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:

 

Section 1.  It is hereby determined to be necessary to construct an extension of the Triangle East Sanitary Sewer, Imp. No. SA-871, Phase 1, to properties known as 4550, 4560, 4570 and 4580 East Johnstown Road, as such dedication is recorded in the Recorder's Office of Franklin County, Ohio, whereby said lots lie along East Johnstown Road.

 

Section 2.  It is hereby determined and declared that this improvement is conducive to the public health, convenience and welfare of the City and inhabitants thereof.

 

Section 3.  That plan of the improvement after the improvement has been completed shall be as shown on the Engineer's plan, which are on file in the office of the Clerk of Council and available for public inspection, and are incorporated therein by reference and made a part thereof.

 

Section 4. The cost of the assessment shall be calculated herein as thirty-three thousand six hundred twenty eight dollars ($33,628) and shall be assessed upon 4550, 4560, 4570 and 4580 East Johnstown Road at an equal amount of eight thousand four hundred seven dollars ($8,407) to each property, which are hereby determined to be specifically benefited by the improvement.  The balance of the cost, approximately estimated to be one hundred twenty three thousand, seven hundred fifty dollars ($123,750) shall be paid by the City of Gahanna.

 

Section 5.  The City Engineer is hereby authorized and directed to prepare and file in the office of the Clerk of Council the estimated assessments of the cost of the improvement.  Such estimated assessments shall be based upon the estimate of cost of the improvement now on file in the office of the Clerk of Council and shall be prepared pursuant to the provisions of this resolution.  When such estimated assessments have been so filed, the Clerk shall cause notice of the adoption of this resolution and the filing said estimated assessments to be served on the owners of all lots and lands to be assessed as provided in Revised Code Section 727.13.

 

Section 6.  The assessments to be levied shall be paid in 20 annual installments, provided however, that the owner of any property assessed may, at his option, pay such assessment in cash within thirty days after passage of the assessing ordinance.

 

Section 7.  It is found and determined that all formal actions of this Council concerning and relating to the adoption of this resolution were adopted in an open meeting of this Council, and that all deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements included Revised Code Section 121.22.

 

Section 8.  That this resolution is mandated by the City Attorney to be technically approved as an ordinance; that the second reading has been waived through suspension of Council rules, is declared emergency legislation for the preservation of the public peace, property, health, safety, and welfare, and shall be in full force and effect immediately upon passage by this Council and on date of signature by the Mayor.
