TO AUTHORIZE THE DIRECTOR OF PUBLIC SERVICE TO AWARD AND THE MAYOR TO ENTER INTO CONTRACT WITH PRO TERRA ENVIRONMENTAL FOR UST REMOVAL AT CERTIFIED STATION AT U.S. 62 AND CHERRYBOTTOM ROAD; TO WAIVE BIDDING PROCEDURES THEREFOR; AND TO DECLARE AN EMERGENCY

WHEREAS, it is mandatory that the City proceed immediately with the removal of fuel holding tanks at the location of U.S. 62 and Cherrybottom Road; and
WHEREAS, two letterhead quotes have been received by specialists in this field of work and the lowest, responsive, and responsible contractor has been recommended by the Director of Public Service and the City Engineer; and
WHEREAS, due to the massive being undertaken in the reconstruction and improvements to four U.S. 62 intersections, it is necessary to move forward with this tank removal and related work in order that the intersection work move forward with no undue delays for appropriate and organized vehicular traffic, all for the preservation of the public peace, health, safety, and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Director of Public Service is hereby authorized to award and the Mayor is authorized to enter into Contract with PRO TERRA ENVIRONMENTAL, 2323 Refugee Road South, Columbus, Ohio 43207, for the Cherrybottom Road UST Removal Project A Part of Improvement No. 653, as said work is outlined on the attached Bid Tabulation, EXHIBIT A, hereto.
Section 2. That funding for this work was set aside in the 1998 Appropriations in the amount of Sixty-two Thousand Eight Hundred Seventy-five Dollars ($62,875) to Account No. 101.145.5541, Capital Project, Streets, to cover the herein costs.
Section 3. That this Council hereby accepts the waiver of the bidding requirements as set forth in Section 135.04 of the Codified Ordinances of Gahanna, and as recommended by the Director of Public Service, due to the specialized nature of this service and timely manner in which this work must be done.
Section 4. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and approval by the Mayor.
