TO AUTHORIZE THE MAYOR TO ENTER INTO CONTRACT TO RELOCATE WEST ALLEY IN OLDE GAHANNA AND TO ENTER INTO CONTRACT TO EXCHANGE A PEDESTRIAN EASEMENT; TO DECLARE THE INTENT TO VACATE TO VEHICULAR TRAFFIC EXISTING WEST ALLEY AND TO DEDICATE THE NEW RELOCATED ALLEY TO PUBLIC USE; AND TO DECLARE AN EMERGENCY

WHEREAS, the City has received a request from Select Properties, Ltd., to purchase certain public right of way to allow the construction of Founder's Plaza; and
WHEREAS, in exchange, Select Properties, Ltd., desires to give to the City certain land for relocation of this public right of way as well as a portion of land for pedestrian walkway; and
WHEREAS, the Director of Development and City Engineer have recommended that Council approve this request and have indicated to this Council that this proposal is in keeping with the overall projection of downtown development; and
WHEREAS, since we are entering the prime building season, it is desirable to effect these agreement at the earliest possible date for orderly design in this area, all for the preservation of the public peace, health, safety, and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into Contract of Sale and Purchase between the City of Gahanna and Select Properties, Ltd., to relocate West Alley in return for land on which to relocate said West Alley along with land for pedestrian walkway, said Contract of Sale and Purchase attached to this ordinance as EXHIBIT I.
Section 2. That it is the intent of this Council to vacate existing West Alley to vehicular traffic, excepting out all public utility easements, and to dedicate to public use the relocated West Alley and pedestrian walkway.
Section 3. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and approval by the Mayor
