TO AUTHORIZE THE MAYOR TO ENTER INTO AMENDED CONTRACT WITH R D ZANDE FOR ACQUISITION OF RIGHT OF WAY INCLUDING PURCHASE AND PAYMENT FOR RIGHT OF WAY ON HAMILTON ROAD; AND TO DECLARE AN EMERGENCY.

WHEREAS, ORD-0044-2003 authorized a contract with R. D. Zande & Associates, Inc. for right of way acquisition services for the Hamilton Road, U.S. 62 to Morse Road, Imp. #784; and
WHEREAS, an amendment is needed to this contract due to changes in the plans by the County Engineer's office, including additional parcels where right of way is needed; and
WHEREAS, the negotiations are ongoing and authorization is needed to purchase and pay for this right of way; and
WHEREAS, it is prudent to proceed to authorize the purchase of this property at this time as well as the amendment to the contract to include additional parcels, all for the continuation of the orderly reconstruction of our main north south artery, all for the preservation of the public peace, health, safety, and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into amended contract with R. D. Zande & Associates, Inc., 1237 Dublin Road, Columbus, OH 43215 for property acquisition services including the purchase and payment for right of way for the Hamilton Road Improvement, Imp. #784 as shown on EXHIBIT A attached hereto.
Section 2. That the amount of EIGHT THOUSAND DOLLARS ($8,000) was appropriated to Account #101.145.5541, Capital Projects, Streets, in prior year appropriations for this acquisition.
Section 3. That NINE THOUSAND ONE HUNDRED FIFTY ($9,150) DOLLARS is hereby supplementally appropriated from the unencumbered, unappropriated balance in the General Fund to Account No. 101.145.5541, Capital Projects, Street, to cover these additional costs.
Section 4. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
