TITLE
AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO AN ACCESS EASEMENT AGREEMENT WITH CENTERPOINT CHURCH FOR THE USE OF PARKING LOT LOCATED AT 670 MCCUTCHEON ROAD; AND AUTHORIZING A SUPPLEMENTAL APPROPRIATION FROM THE CAPITAL IMPROVEMENT FUND (3250)
BODY
WHEREAS, Sunpoint Park, located at 670 McCutcheon Road in the City of Gahanna, is a popular public park featuring a playground, basketball courts, and athletic green space, resulting in high visitation and insufficient existing parking; and
WHEREAS, CenterPoint Church, adjacent to Sunpoint Park, has historically served as a de facto overflow parking location for park visitors due to its proximity and capacity; and
WHEREAS, the City desires to formalize access to the CenterPoint Church parking lot through a 20-year access easement agreement allowing public use of the parking facility during times outside of the church’s normal operating hours; and
WHEREAS, the property owner shall retain responsibility for maintenance of the parking facility under the terms of the agreement; and
WHEREAS, the Administration has recommended entering into said access easement agreement and requests a supplemental appropriation to fund the first payment under the agreement; and
WHEREAS, it is necessary to appropriate funds from the Capital Improvement Fund to enable the City to fulfill its financial obligation under the easement agreement.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. The Mayor is hereby authorized to enter into an Access Easement Agreement with CenterPoint Church, in a form acceptable to the City Attorney, for the use of the church’s parking lot located at 670 McCutcheon Road, Gahanna, Ohio, for a period of twenty (20) years; said Agreement attached hereto as EXHIBIT A and incorporated herein.
Section 2. There is hereby appropriated the sum of One Hundred Fifty Thousand Dollars ($150,000) from the unappropriated and unencumbered balance of the Capital Improvement Fund (Fund 3250) to Account 325.06.550.5515 - Land Acquisition, for the purpose of making the first payment under the Supplemental Agreement attached hereto as EXHIBIT B and incorporated herein.
Section 3. That this Ordinance shall be in full force and effect after passage by this Council and 30 days after signature of approval by the Mayor.
