AN ORDINANCE TO SET FORTH A STATEMENT OF MUNICIPAL SERVICES TO BE PROVIDED TO THE AREA CONTAINED IN THE PROPOSED ANNEXATION OF 2.7+/- ACRES FROM JEFFERSON TOWNSHIP TO THE CITY OF GAHANNA; REQUESTED BY FRANKLIN E. ECK, JR., AGENT FOR PETITIONERS; AND TO DECLARE AN EMERGENCY.

WHEREAS, a Petition for the annexation of 2.7+/- acres from Jefferson Township to the City of Gahanna has been filed by Franklin E. Eck, Jr., agent for petitioners; and

 

WHEREAS, a hearing on said Petition is scheduled before the Board of County Commissioners of Franklin county on November 7, 2001; and

 

WHEREAS, Section 709.31 of the Ohio Revised Code requires that before said hearing the Municipal Legislative Authority shall adopt a statement indicating what services, if any, the municipal corporation will provide to the territory proposed for annexation upon annexation, and it is, therefore, necessary to effect this legislation prior to the hearing date for the orderly progression of the annexation procedure, and for the preservation of the public peace, health, safety and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1. That the City of Gahanna will provide the following municipal services for the 2.7+/- acres in Jefferson Township upon the acceptance of the annexation of the said area to the City of Gahanna:

 

POLICE:

 

1.  The tract is located on a main thoroughfare.

 

2.  The City of Gahanna provides 24-hour police protection, criminal investigation and traffic control through the efforts of various segments of the Division of Police.  The department is comprised of 53 sworn full-time officers, 5 sworn part-time officers, 25 sworn reserve officers, and 8 civilians.

 

3. Optimally the department operates 8 cruisers on patrol throughout the City per shift; a shift never has less than 5 cruisers on patrol.

 

4.  The entire area is routinely patrolled  by the officer assigned to the area in question; anticipated response time to a police emergency is 3 to 5 minutes; non emergency response is generally 5 to 10 minutes.

 

5.  The City of Gahanna is part of the 9-1-1 Emergency System that allows quick response to emergency situations; the department anticipates no problems in providing police protection to this area of annexation.

 

SANITARY SEWER AND WATER:

 

1. Water service is available from the 12" main along the south side of Johnstown Road. It is understood that any extension of water lines is the responsibility  of the owner/developer.

 

2. Sanitary sewer service is available from the Triangle north sewer, which is on the front of the property along Johnstown Road.  It is understood that extension of the sewer is the responsibility of the owner/developer.

 

STREETS:

 

The owner/developer shall be responsible for the installation of internal street patterns, if any. Upon acceptance of these improvements by the City of Gahanna, the City will be responsible for street and light maintenance.

 

SANITATION:

 

Upon being annexed to the City of Gahanna, the proposed annexation shall receive sanitation service as provided in Chapter 941 (Garbage and Refuse Collection) of the Codified Ordinances.

 

FIRE:

 

FIRST RESPONSE FROM: Station 131- Mifflin Township, 475 Rocky Fork Boulevard, Gahanna. Approximate response times: 3-3 1/2 minutes. Apparatus responding: Engine 131 or Medic 131, Ladder 131, and/or Rescue/Engine 133.

 

SECOND RESPONSE FROM: Station 134-Mifflin Township, 422 McCutcheon Road, Gahanna. Approximate response times: 3 1/2 - 4 minutes. Apparatus responding: Engine 134 or Medic 134, and Battalion 131.

 

THIRD RESPONSE FROM: Station 121- Plain Township, 9200 Johnstown Road, New Albany. Approximate response times: 5-5 1/2 minutes. Apparatus responding: Engine 121, Ladder 121 or Medic 121.

 

Note:  Mifflin Township is constructing a new fire station (Station 133) located at 501 Beecher Road, in Gahanna, Projected opening for this fire station is late August 2001.  Thus, this fire station would be on the first response alarm with an approximate response of 1 minute.  A combination Rescue/Engine/ALS unit with four (4) full-time personnel per shift will be assigned to this fire station.

 

RIGHT OF WAY - ANNEXATION REQUIREMENT:

In accordance with the adopted Thoroughfare Plan of the City of Gahanna, East Johnstown Road is designated as a minor arterial roadway.  Per the City of Gahanna, COG Section 1109.02, a minor arterial right-of-way shall be 80 feet. According to our records, the present right-of-way is 30 feet from the centerline of Johnstown Road. An additional 10 feet of right-of-way would be required to meet section 121.05 code requirements.

 

Section 2.  That the Clerk of Council is hereby authorized and directed to personally deliver a copy of this legislation to the office of the Board of Commissioners of Franklin County before 10:00 a.m. on Wednesday, November 7, 2001.

 

Section 3.  That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation, and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
