TO AUTHORIZE THE DIRECTOR OF PUBLIC SERVICE TO AWARD AND THE MAYOR TO ENTER INTO CONTRACT WITH COLUMBUS ASPHALT FOR THE SOUTH HAMILTON ROAD/TECH CENTER DRIVE PROJECT, IMPROVEMENT NO. 770; TO SUPPLEMENTALLY APPROPRIATE $331,906; AND TO DECLARE AN EMERGENCY.

WHEREAS, bids were opened for the Hamilton Road/Tech Center Drive, Improvement No. 770 on June 1, 2001, pursuant to Council authorization, and Council is proceeding with the awarding of the contract; and
WHEREAS, the lowest, most responsive, and responsible, bidder has been recommended by the Director of Public Service; and
WHEREAS, it is imperative to move forward with this project due to construction time remaining this year, all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Director of Public Service is hereby authorized to award, and the Mayor is authorized to enter into contract with COLUMBUS ASPHALT, 1196 Technology Drive, Gahanna, Ohio 43230, for the South Hamilton Road/Tech Center Drive, Improvement No. 770, without the alternate bid encompassing the fiber deployment for the project; in accordance with City specifications; bid tabs attached as EXHIBIT A.
Section 2. That funding in the amount of THREE HUNDRED THIRTY ONE THOUSAND NINE HUNDRED SIX DOLLARS ($331,906) is hereby supplementally appropriated from the unencumbered, unappropriated balance of the General Fund, to Account No. 101.145.5541 Capital Projects, Streets, to cover the herein costs.
Section 3. That funding in the amount of NINETY TWO THOUSAND SEVEN HUNDRED SEVEN DOLLARS ($92,787) was appropriated to Account No. 101.145.5541, Capital Projects, Streets, in the 2001 Appropriations and reallocated by MR-0038-2001.
Section 4. That Ordinance No. ORD-0001-2001, passed January 2, 2001, is hereby amended to reflect this supplemental appropriation.
Section 5. That for the reasons set forth in the preamble herein above this ordinance is declared emergency legislation and shall be in full force and effect immediately after passage by this Council and signature approval by the Mayor.
