TO SUPPLEMENTALLY APPROPRIATE FUNDS FOR ADDITIONAL SANITARY SEWER PROCESSING FEES FOR THE CITY OF COLUMBUS; AND TO AUTHORIZE PAYMENT FOR A THEN AND NOW PURCHASE UNDER OHIO REVISED CODE 5705.41(D)(1); AND TO DECLARE AN EMERGENCY.

WHEREAS, Gahanna pays the City of Columbus to process Gahanna’s effluent; and

WHEREAS, the City just received Columbus’ 4^th quarter, 2015 water and sanitary invoice; and

WHEREAS, the 2015 purchase order to cover the sanitary processing expense is short $91,066; and

WHEREAS, the Director of Public Service is requesting a supplemental appropriation from the unencumbered/unappropriated balance of the Sanitary Sewer Fund to cover the shortfall; and

WHEREAS, there were not enough funds encumbered for the 4^th quarter charges and a then and now purchase must be authorized under Ohio Revised Code (ORC) 5705.41(D)(1); and

WHEREAS, the Director of Finance has certified that funds were available then at the time of purchase and now at the time of payment, appropriated, collected or in the process of collection and free from any previous encumbrance; and

WHEREAS, in order to process 4^th quarter payment to the City of Columbus it is imperative to move forward as quickly as possible, and all for the preservation of the public peace, health, safety and welfare.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:

Section 1. That funding in the amount of NINETY ONE THOUSAND SIXTY SIX DOLLARS ($91,066) is hereby supplementally appropriated from the unencumbered, unappropriated balance of the Sanitary Sewer Fund to Account No. 661360.5269, Sewer Rental.

Section 2. That ORD-0136-2015, passed December 21, 2015, is hereby amended to reflect this supplemental appropriation.

Section 3. That the Director of Public Service is authorized to make payment in the amount of NINETY ONE THOUSAND SIXTY SIX DOLLARS ($91,066) then and now purchase under ORC 5705.41(D)(1) to the City of Columbus for sanitary sewer processing fees.

Section 4. That, for the reasons set forth in the preamble herein above, this Ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
