TO AMEND SR-0018-2009, THE RESOLUTION TO DECLARE THE NECESSITY AND INTENT TO APPROPRIATE REAL ESTATE FOR PERMANENT EASEMENT, TEMPORARY EASEMENT AND SLOPE EASEMENT FOR THE WIDENING OF THE HAMILTON/GRANVILLE INTERSECTION; IMPROVEMENT NO. 883; FOR PROPERTY KNOWN AS 407 GRANVILLE STREET AND OWNED BY BP EXPLORATION & OIL, INC., BY THE CITY OF GAHANNA, OHIO.

WHEREAS, the City wishes to widen the Hamilton/Granville intersection by adding additional turn lanes and signalization and will need to purchase permanent construction easement as well as a slope and temporary easements totaling 0.2435+/- acres; and
WHEREAS, said property is located at 407 Granville Street and at the time of passage of SR-0018-2009 the ownership had been transferred from BP Exploration & Oil, Inc. to F. W. Englefield IV and Benjamin B. Englefield; and
WHEREAS, this error occurred as the ownership changed after the right-of-way documents were prepared; and
WHEREAS, it is imperative to acknowledge this change of ownership and move forward as quickly as possible in order meet the ODOT right-of-way clear date, and all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That this Council hereby amends SR-0018-2009 to note that the property known as 407 Granville Street is no longer owned by BP Exploration & Oil, Inc. but by F. W. Englefield, IV and Benjamin B. Englefield.
Section 2. That this Council hereby reiterates and declares the necessity and intent to appropriate certain real estate for purchase consisting of 0.0789+/- acres for permanent easement; 0.0244+/- for slope easement, and 0.1402+/- acres for temporary construction easement; by the City of Gahanna for widening of the Hamilton/Granville intersection; Improvement No. 883; 407 Granville Street; pursuant to and in accordance with the Codified Ordinances of the City of Gahanna, the Charter of the City of Gahanna, and the Constitution of the State of Ohio, Chapter 719 and Chapter 163, Ohio Revised Code, said parcels more particularly described in EXHIBIT A, attached to this resolution and made apart hereof.
Section 3. That the City Attorney or his representative is hereby reauthorized and redirected to cause a written notice of the adoption of this Resolution to be given to the owner/s/, person/s/, in possession of and person/s/ having a real or possible interest of record in the premises described in EXHIBIT A herein, and said notice shall be served by said City Attorney or his representative, who shall make return of said service of notice in the manner provided by law.
Section 4. That, for the reasons set forth in the preamble hereinabove, this statutory resolution is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
