TO AUTHORIZE THE MAYOR TO ENTER INTO AN AMENDMENT TO CONTRACT WITH GAHANNA-CREEKSIDE INVESTMENTS, LLC TO ADD MILL STREET UTILITIES PROJECT, IMPROVEMENT NO. 845 AND 846; TO SUPPLEMENTALLY APPROPRIATE FUNDS THEREFOR; AND TO DECLARE AN EMERGENCY.

WHEREAS, the Creekside project provides an opportunity to address issues of old sanitary sewer, waterline and street on Mill Street; and
WHEREAS, the City Engineer has recommended that we amend the current contract with Gahanna-Creekside Investments, LLC established by ORD-0217-2004, to include this work; and
WHEREAS, it is imperative to move forward with this ordinance as soon as possible in order to start construction in the summer, all for the preservation of the public peace, health, safety, and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into Amendment to Contract with Gahanna-Creekside Investments, LLC, for Mill Street Utilities Project, Improvement No. 845 and 846; in accordance with City Specifications; contract attached as EXHIBIT A.
Section 2. That funding in the amount of FIFTY FOUR THOUSAND ONE HUNDRED THIRTY FOUR DOLLARS ($54,134) is hereby supplementally appropriated from the unencumbered, unappropriated balance of the WSCI Fund to Account No. 652.351.5596, Miscellaneous Water Improvements.
Section 3. That funding in the amount of ONE HUNDRED TEN THOUSAND SIX HUNDRED EIGHTY DOLLARS ($110,680) is hereby supplementally appropriated from the unencumbered, unappropriated balance of the SSCI Fund to Account No. 662.361.5596, Miscellaneous Sewer Improvements.
Section 4. That funding in the amount of ONE HUNDRED TWENTY ONE THOUSAND SEVEN HUNDRED TWENTY NINE DOLLARS ($121,729) is hereby supplementally appropriated from the unencumbered, unappropriated balance of the General Fund to Account No. 101.360.5541, Creekside - Mill Street Utilities.
Section 5. That ORD-0001-2006, passed January 2, 2006 is hereby amended to reflect this supplemental appropriation.
Section 6. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately after passage by this Council and on date of signature approval by the Mayor.
