TO AMEND THE CONTRACT WITH MOODY NOLAN LTD INC., TO COVER ADDITIONAL EXPENSES OUTSIDE THE ORIGINAL SCOPE OF SERVICES, AS AMENDED; FOR THE MORSE ROAD/US 62 INTERSECTION, IMPROVEMENT NO. 753; TO SUPPLEMENTALLY APPROPRIATE $46,580; AND TO DECLARE AN EMERGENCY.

WHEREAS, ORD-0032-2001 authorized the Mayor to enter into Contract with Moody Nolan, for engineering design services for the Morse Road/US 62 Intersection, Improvement No. 753; and
WHEREAS, ORD-0189-2002 amended this contract to extend the consultant services to finish design work; and
WHEREAS, ORD-0103-2003 amended this contract to add FEMA imposed additional requirements outside the scope of services; and
WHEREAS, additional items are being addressed to change the scope of services including fiber communications, utility relocation, update of the OPWC grant application, and a drainage study; and
WHEREAS, it is imperative to move forward with this so that design work can be completed in a timely fashion to keep the project on its current timetable, all for the preservation of the public peace health safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into extended contract with MOODY NOLAN LTD INC., 1776 East Broad Street, Columbus Ohio 43203-2039, for consultant services for design work for the Morse Road/US 62 intersection, Improvement No. 753.
Section 2. That funding in the amount of FORTY SIX THOUSAND FIVE HUNDRED EIGHTY ($46,580) DOLLARS is hereby appropriated from the unencumbered, unappropriated balance of the General Fund to Account No. 101.145.5533, Capital Projects, Engineering, to cover the herein costs.
Section 3. That ORD-0001-2003, passed January 2, 2003, is hereby amended to reflect this supplemental appropriation.
Section 4. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect upon passage by this Council and on date of signature approval by the Mayor.
