WHEREAS, the City of Gahanna has determined that there exists within the City boundaries vacant, nonproductive land, the presence of which detracts from community attractiveness and poses a threat to economic health and public safety; and

 

WHEREAS, it is in the best interests of the City to move forward in a timely fashion to establish a Land Reutilization Program to facilitate effective reutilization of such nonproductive land, all for the preservation of public peach, health, safety and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the existence of nonproductive (tax delinquent, vacant) land within the boundaries of the City of Gahanna is such as to necessitate the implementation of a Land Reutilization Program to foster the return of such nonproductive land to tax revenue generating status or the devotion thereof to the public use.

 

Section 2.  That the City of Gahanna hereby establishes, pursuant to Chapter 5722 of the Ohio Revised Code, a Land Reutilization Program with the purpose of facilitating the effective reuse of nonproductive land within the City.

 

Section 3.  That the Director of the Department of Development is authorized and directed to utilize the provisions of Chapter 5722 of the Ohio Revised Code to facilitate the effective utilization of nonproductive land by obtaining such land through a sale pursuant to a foreclosure proceeding initiated by the Treasurer of Franklin County (Section 5722.03 of the Ohio Revised Code) and/or through a sale of forfeited lands by the Auditor of Franklin County (Section 5722.04 of the Ohio Revised Code) and/or through the conveyance in lieu of foreclosure (Section 5722.10 of the Ohio Revised Code) and/or any other means deemed appropriate as part of its Land Reutilization Program.

 

Section 4.  That the Director of the Department of Development or his or her designee, is authorized and directed to act as closing agent for the conveyance of title pursuant to the Land Reutilization Program and to execute any and all necessary agreements, subject to the approval of the City Attorney, in order to implement the Land Reutilization Program of the Ohio Revised Code, Section 5722.

 

Section 5That for the reasons set forth in the preamble hereinabove, the ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
