AN ORDINANCE TO AMEND ORD-0014-2021 AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO CONTRACT WITH STRAWSER PAVING COMPANY, INC., FOR THE 2021 RESIDENTIAL STREET PROGRAM ST-1075; AND TO APPROVE A SUPPLEMENTAL APPROPRIATION; WAIVE SECOND READING.

WHEREAS, an Ordinance authorizing the mayor to enter into contract with Strawser Paving Company, Inc. for the 2021 Residential Street Program ST-1075 was previously approved; and
WHEREAS, due to clerical error, the request for a ten-percent contingency to cover any unforeseen construction costs, as well as the request for supplemental appropriation, was not included in the original legislative text; and
WHEREAS, it is imperative to proceed with this Ordinance for the preservation of the public peace, property, health, safety, and welfare.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into contract with Strawser Paving Company, Inc., 1595 Frank Rd., Columbus, Ohio 43223, for the Residential Street Program, as described in EXHIBIT A, attached hereto and made a part herein.
Section 2. That funds in the amount of FIVE MILLION FORTY-FOUR THOUSAND SIX HUNDRED EIGHTY-TWO DOLLARS AND SIXTY-EIGHT CENTS ($5,044,682.68), be and is hereby appropriated to the following account numbers:
$2,590,000.00 from 325.06.550.5500 (2021 Appropriations)
$1,964,160.00 from 325.06.550.5500 (2021 Appropriations)
$290,522.68 (from prior year’s contingency street funds)
Section 3. That TWO HUNDRED THOUSAND DOLLARS ($200,000.00) is hereby supplementally appropriated from the unappropriated, unencumbered balance of the Permissive Tax Fund to account 231.11.000.5505.
Section 4. That ORD-098-2020, passed December 21, 2020, is hereby amended to reflect this appropriation.
Section 5. That the second reading is hereby waived.
Section 6. That any Ordinances or parts of Ordinances in conflict herewith are hereby repealed.
Section 7. That this Ordinance shall be in full force and effect after passage by Council and on date of signature approval by the Mayor.
