TO AUTHORIZE THE MAYOR TO ENTER INTO REAL ESTATE PURCHASE AGREEMENT WITH JOHN R. ECKARD II AND ROBIN S. ECKARD FOR THE PURCHASE OF REAL PROPERTY LOCATED AT 537 NORTH HAMILTON ROAD; TO SUPPLEMENTALLY APPROPRIATE $335,000 THEREFOR; AND TO DECLARE AN EMERGENCY

WHEREAS, the property located at 537 Hamilton Road is situated at the location of the proposed northern roundabout of the Hamilton Road Central project and the rear of the property is key to the park plan for the area; and
WHEREAS, at this time the owner is willing to sell which may not be the case when the rest of the Hamilton Road right of way will be purchased; and
WHEREAS, at that time the use of state or federal funds will require extensive relocation assistance compensation; and
WHEREAS, the City Engineer has advised that the City purchase this property now while the owner is willing to sell, all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into Real Estate Purchase Agreement with John R. Eckard II and Robin S. Eckard, 537 North Hamilton Road, Gahanna, Ohio 43230, for the purchase of real property located at 537 North Hamilton Road, Gahanna, Ohio 43230, said agreement attached hereto as EXHIBIT A.
Section 2. That NINETY TWO THOUSAND SEVEN HUNDRED TWENTY DOLLARS ($92,720) is hereby supplementally appropriated from the unappropriated, unencumbered balance in the General Fund to Account No. 101.431.5511, Parks, Capital Projects.
Section 3. That TWO HUNDRED FORTY TWO THOUSAND TWO HUNDRED EIGHTY DOLLARS ($242,280) is hereby supplementally appropriated from the unappropriated, unencumbered balance in the General Fund to Account No. 101.991.5932, Transfer to Streets Fund.
Section 4. That TWO HUNDRED FORTY TWO THOUSAND TWO HUNDRED EIGHTY THOUSAND ($242,280) is hereby supplementally appropriated from the unappropriated, unencumbered balance in the Streets Fund to Account No. 220.330.5541, Streets, Capital Improvements.
Section 5. That ORD-0001-2006, passed January 2, 2006, is hereby amended to reflect these supplemental appropriations.
Section 6. That, for the reasons set forth in the preamble hereinabove, this ordinance shall be deemed emergency legislation and shall be in full force and effect after passage by this Council and upon date of signature approval by the Mayor.
