TO AMEND CHAPTER 1403, INSPECTIONS, OF THE CODIFIED ORDINANCES OF GAHANNA, OHIO, IN ORDER TO ADOPT THE 2000 INTERNATIONAL PROPERTY MAINTENANCE CODE

WHEREAS, the 2000 International Property Maintenance Code has been adopted in many of the jurisdictions in the greater Columbus area; and

 

WHEREAS, the Franklin County Board of Health is recommending adoption of the 2000 International Property Maintenance Code in the interest of code consistency; and

 

WHEREAS, the 2000 International Property Maintenance Code does provide greater specificity than the current Housing Code of the Codified Ordinances; and

 

WHEREAS, pursuant to Section 4.16 of the Gahanna City Charter, the City may adopt standard codes without reproducing the same at length in the ordinance; and

 

WHEREAS, the Building Inspector has requested the adoption of the 2000 International Property Maintenance Code; and

 

WHEREAS, adoption of this code is vital in order to better protect the public health, safety and general welfare of the citizens of Gahanna;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That Chapter 1403, Inspections, of the Codified Ordinances of the City of Gahanna is hereby amended in accordance with EXHIBIT A, attached hereto and made a part herein.

 

Section 2.  That existing Chapter 1403, Inspections, attached hereto as EXHIBIT B, or any ordinances or parts of ordinances in conflict herewith, are hereby repealed.

 

Section 3.  That nothing in this ordinance or in the International Property Maintenance Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in Section 2 of this ordinance, nor shall any just or legal right or remedy of any character be lost, impaired or affected by this ordinance.

 

Section 4.  That this ordinance shall be in full force and effect after passage by this Council and 30 days after signature of approval by the Mayor.
